ota: cts OC7 2 31963 I Docket No. _ 50-205 Mrs. Margaret C. Hayes 117 Tassipais Road Berkeley 8, California Dear Mrs. Hayent This replies to your letter of August 23, 1963 in which you esked several questions concerning the licensing of nuclear power re-actors.

A licensee is required to maintain concentrations of radioactivity in effluents from a reactor within the limits defined by 10 CFR Part 20. " Standards for Protection Against Radiation" a copy of which is enclosed. In the event that specified low levels of i radteactivity are exceeded, the licensee.te in violation of the Coundssion's regulations. The licensee, on determining that his perstissible limits are being exceeded, must take tsumediate steps to reduce the level to within permissible concentrations. Such steps would normally consist of holding up liquid and gaseous af.

fluents until their radiomettwity decreased to levels which would permit their release. If such holdup is not practicable, then the licensee may be obitged to curtail or shut down the reactor in order to comply with the terna of his license.

As noted in the pamphlet which me sent; you with our letter of 1 August 6,1963, licensed power reactors are inspected periodically by representatives of the Ceandoston's Division of Complismos to assure that operations are being conducted in accordance with the terms of the license.

Enclosed is a copy of the Ceemission's regulation,10 CFR Part 50,

" Licensing of Production and Utilization Facilities". Section 50.10(b) concerns the point which you have raised. That section provides that the construction of a proposed reactor may not begin 5

prior to the isomence of a construction persdt by the Atende Emergy Commission. You will note that " construction", as defined la the above etted section, does not faciude site excavation, construction of rosAwys, rs11 read spurs, temporary buildings for use in oomaec-tion with constructies, etc. However, the Coundssion has potated out usay times that any such site preparation prior to the issuance of a constructica permit is undertakaa at the applicant's risk sad  ;
