Dear Mr. Kingsley:

l On March 22nd we contacted, by phone, Mr. Howard l

Shapar of your Division of Licensing and Regulation to determine I

whether the Atomic Energy Commission would be willing to become.

involved in the captioned matter.

He asked that we send the' Pleadings to you and indicated that you would try to call us on

Monday, March 25th, to let us know what the A.E.C. position will l

be.

We have determined that our approach will be (1) a l

Demurrer on the ground of laches, (2) a Motion to -Strike Paragraph XVII (Radiation Safety Consideration) as irrelevent and redundant, (3) an answer as to the remaining allegations.

The A.E.C. will probably not be concerned with the Demurrer or Answers but will be directly concerned with the Motion to Strike.

Our argument in favor of that Motion will be:

1. Radiation Safety considerations in this case are irrelevent because the Federal Government has occtipied the field.
2. Radiation Safety considerations in this case are irrelevent because the Stat'e of California has occupied the field.
3. By conditioning the Use Permit upon Pacific Gas and Electric's obtaining all necessary permits from State and Federal Agencies the Board of Supervisors has completely. fulfilled its obligation to consider the health, safety and general welfare of the public as required by the Ioning Ordinance. (The theory here is that the Board of Supervisors is obligated to consider radiation safety but may pass the obligation on to State and Federal Agencies.)

4. That Paragraph XVII is merely a speculation as to what will develop at a hearing. (The theory here, by implication, is that the Board must hear and decide radiation safety questions).

In our pleadings we intend to raise the issue of Federal and State occupancy of the field so that intervention or an Amicus Brief by the A.E.C. or State will be possible.

We also feel that this point may establish a definite precedent in the conduct of hearings by local boards and either facilitate or make unduly burdensome those local hearings.

l We plan to file our Demurrer, Motion to Strike and Answer on April 1,1963 and forsee that on that day the Court will set a date for argument.

Should the A.E.C. wish to intervene or file its Amicus Brief we suggest that the Court be apprised as soon as possible.
