This is in reply to your letter of April 5,1963.

y At the publio Utilities Cosmaission hearing, I carefully esplaimed that I took so official position as te whether Pacific ens and niectrio ny -WM be authorised to construct a power plant in Marin-Sonoma area, or, if it were to he so authorised, whether that plant should be at modega need.

You have repeatedly ignored this important part of my statessent while reciting the remaining portion.

Peoonen page 2 The Governor made no comunitment but was made aware of the position I was *= Hag, a position that is supported by the entire history of our national effort in atomic energy development, by the California Atende Energy Development and Radiation Protection Law, and by the vast majority of scientists.

That the Governor found no fault with this position, which I had consistently adopted, is evident from Mr. varley's letter of septa =he 28, 1962, to Mr. Heilands, in which it was affirmed that " state agencies involved have acted properly and in accordance with established law."

To convert the Governor's understanding of the problem into the misstatement that he "had agreed that the facility should go forward" is to ignore any proper concern he might have had, then or now, as to whether a power plant should be placed os modega mead.

At a recent press conference, the Governor was asked, "in view of the public opposition to the modega any power plant develop-ment...., do you think this private company should hold off development?"

As you will note, the question did not relate to the nuclear power aspects; and the Governor replied that he had listened to the arguments but had reached ras conclusion.

Whatever conclusion he may eventually reach with res'ect to p

the merits of placing a power plant at modega Head will lie in the area that I have consistently avoided discussing.

In respect to the use of nuclear power in California, the caos in favor of it is clear from the record, as the Public Utilities Coumission recognized.
