Dear Mr. Watters:

This replies to your letter of February 12, 1964 consorslag the reactor proposed for construction at Bodess Bay, California. By letter of July 16, 1963 we pointed out to you that certain " constructive" such as site escavatism, construction of r E j., etc., is permissible under Sec-tien 50.10(b) of the Commission's regulations, prior to the aivat= imp of a construccise penait, but that such

" construction" must be undertaken at the applicant's risk.

Prior to undertaking excavation for the reactor contatament structure, Facific Gas & glectric Company requested sa interpretation from the Omanission's General Connes1 ese-eersing the application of section 50.10(b) therete.

The point was again emphasised in the letter of reply dated July 23, 1963 by Mr. Joseph F. Hennessey, General Counsel to the Atomic Energy Commission. Copies of this correspondence have been available for inspection by the public at the Commission's San Freccisco Operations Office at 2111 Bancroft Way in Berkaley.
