Dear Mr. Carvey:

i I-This is to acknowledge your letter of August 15, 1964, to the President

, concerning the nuclear power reactor proposed for construction at Bcdega Bay, Cali fornia. <

I have been ja communication cvith Chairman Seafiorg of the Atomic Ent.rgy )

Commission concern 2nn your letter. As you know, t>e safety of the proposed plant is under study by the Commission's "regulaory technic 31 staff and the Advisory Committee on Recctor Safeguards. This study till include a critical r(vidw of all information relating to the safety of the reactor, including consideration of the geology and seismology of the area.

Upon completion of these reviews, a public hearing will be held befc h an Atomic Safety and Licensing Board. In accordance with the legal !

requirements for such proceedings, the decision of the Atomic Safety and Licensing Board will be based solely on the record fevelrped at the hearing. Persons whose interest may be affected may inters p.e in the h:aring and may seek review of the Board's decision by the Commission.

As you know, the Commission has announced that the public heacing on the Bodega Bay application will be held in Santa Rosa, California, Chairman Seaborg has assured me that you and your organizat:,on w:11; of

$ourse, have an opportunity to file a petition with the Cornsion to

Intervene in the hearing.

In regard to the matter of conservation, I have referred a copy of your 1ctter to Secretary Udall and have asked that he communicate with you directly concerning that part of your letter relating to preservation of the land for park use and as a marine biology station.
