The Ccmission does not desire to participate in the present proceeding.

We have carefully considerei the outline of the proposed ar6ur.ent by the County of Scace.a as set forth in your letter of March 22, and have concluded that participation by the Commission in the case as amicus curiae or as applicant for intervention is not an appropriate mechanism by vnich the Commission would wish to undertake the resolutica of any quos-tious which might arise concerning its authority in relation to that of states and local authorities.
