We are confident. that these pi-d. ires and their provision for public bearing will enable all interested persons to acquaint themselves with the details of Pacific Cas & Electric Company's proposal and will assure thorough consideration of all aspects of the proposed plant bearing upon the question of whether it can be constructed and operated at the proposed site without undue risk to the health and safety of the public.

It'should be noted, however, that auch natters as local soning and the esthetics of the site are matters wkthin local and state jurisdiction and are not within the purview of the Atomic Energr Commission. Concerning your reference to construction activity at the proposed site, enclosed is a copy of the Commissian's regulation,10 CF2 Part 50, " Licensing of Productim and Utilization Facilities." Section 5G.10(b) concerns the point which you have raised. That section provides that the ccustruction of a proposed reactor may not begin prior to the issuance of a con-struction permit ttr the Atostic Energy Commission. You will note that acountractica*, as defined in the above cited section, does not include site excavation, construction of roadways, railroad spurs, 1
