l Honorable Clair Ragle

-3 The statutes and the rules and regulations of the Comnission require that a public hearing be held to consider dether or mot a construction permit for a facility e a type under discussion should be issued. mile the Commission is itse f enjoined by the Atomic Enargy Act to promote the coasma defense and curity and to promote the health and safety of the public, the public y esedings afford any person whose interest may be xy~

H";affected an opportuni to participate in the proceedings. The particular l

rules under which such ticipation may take place are found in part 2, Title 10. Code of Federa Regulations, Chapter 1 (a copy of which is enclosed).

Th's development of. atomic ene for broadly beneficial purposes om an i

ecomon>ically competitive basis is of great concern to the Comission. In this we fully support and are ded by the national policy as expressed in the Atomic Baergy Act of'1954 at:

1 "a.

the development, use, and oatrol of atomic energy shall be g

directed so as to make the mash = contribution to the

.- nw -

x ^ general welfare, subject at I times to the paramount objective of making the max contribution to the common defense and security; and "b.

the development, use, and control of atomic energy shall Le directed so as to promote world p e, improve the general welfare, increase the standard of 1 ing, and strengthem free competition-in private enterprise."

(

Thus, the application of Pacific Cas and Electri company for authorization to build a nuclear reactor is consistent with the tional policy as expressed in the Atomic Energy Act of 1954, as ame ed.

It is also in accord with the legal and procedural requirements o the statute. At this point them, our primary interest in considering who r or not to grant the requested construetiem authorization is to determine i there would be adequate protection to the health and safety of the pub c from the potential hazards involved. The health and safety of th public is the overriding consideratida in detenaimin8 ukether or not a truction penait should be issued to em applicant. In = = f = f ug the estion of %.

auclear plant safety, the Coimaission is aware of and takes oconsideha-ties the potential kasards arising from the invoatory of radio etive

\\

materials which are generated.and stored within a nuclear plant and for which safe means of disposal must be providad.

9 To assure that adequatnesafeguards to public health and safe are provided in proposed nuclear reactor facilities, the Cocaission relies

regulatory staff and it Advisory Committee, both of whom are knowledge-able in the particular f Ids of reactor technology pertiment to safety and appreciate the limita ions and uncertainties attendant to this l

knowled e.

The Ceamission has also established licensing boards composed' d

i of tuo technical and one moytechnical menbars to conduct its public hearings. By theos means th Commissies ces be -assured that in every phase of its proceedtags the ety issues are considered by eenpetent persons.

l The commission will issue a conderection permit for a nuclear power plant only aftse a thorough evaluation has been made of all factors which might i

AEC RECEIVES APPLICATION FOR CONSTRUCTION PERMIT FOR PACIFIC GAS AND ELECTRIC COMPANY POWER REACTOR

)

/

The Atomic Energy Commission has received an application from Pacific Gas and Electric Company for a permit to construct a 325,000 electrical kilowatt nuclear power plant at Bodega Bay, approximately 50 miles northwest of San Francisco.

Construction of the plant, powered by a boiling water reactor, is proposed on a 225-acre tract at the south end of s

l-Bodega Head, a peninsula separating Bodega harbor from the l.

Pacific Ocean.

l The application of PG&E will be reviewed by the AEC regula-l tory staff and by the Commission's Advisory Committee on Reactor Safeguards.

Before the Commission can make a determination on the application, a public hearing, as required by law, must b'e held.

In view of the public interest in the proposed reactor, AEC has decided that the hearing will be held in California.

Copies of the PG&E application are available fo'r public inspection at the Commission's Public Document Room, 1717 H Street NW, Washington, D.

C.,

and at the Commission's San Francisco Operations office, 2111 Bancroft Way, Berkeley, California.

l l (NOTE TO EDITOAS AND CORRESPONDENTS:

This information is being issued simultaneously by the Commission's San Francisco Operations Office in Berkeley, California.)
