Your letter to Secretary Udall concerning proposed con-struction of a nuclear power plant. on. Bodega Head by. the i

Pacific Gas and Electric Company has been referred to the l

Atomic Energy Connaission for reply, inasmuch as the Com-mission is the Federal Agency responsible for the review of applications for construction. permits and operating licenses for such facilities.

The Commission has received an application by the Pacific Gas and Electric Company-by I

which they seek a permit to construct a nuclear power plant on Bodega Head.

This application is, at the present time, being evaluated by the Commtission's staff.

The i

Cousnission's review will be conducted in accordance with i

the provisions of the Atomic Energy Act of 1954, as amended, and with the regulations of the Commission which pertain to i

such cases.

Copies of Part 50, Title 10, code of Eederal Regulations, Chapter 1, and Amendments thereto, presently I

in effect, are attached.

1 The application will not only be reviewed by the Consnission but also by its Advisory Comunittee on Reactor Safeguards (ACRS).

Prior to any action involving the issuance of a permit, a formal report by the ACRS will.be made and pub-l lished and the case will be set down for public hearing.

l In additiou, the Fish and Wildlife Service of the. Depart-ment of the Interior has been requested to provide a report to the AEC conc'erning the effect of the proposed facility i

on the surrounding environment.

It is expected that this report will also be made available for public. inspection.

The position that the Comunission staff will take with respect to issuance of the permit, together. with-a hazards analysis by the staff, will be published prior to such a hearit t,.

The final determination as to whether or not a permit.will be issued will depend upon the-evi-'

dance presented :in~ the public hearing and the findings i

resulting. therefrom.

. The Connaission has announced that such a hearing in this case will be held in California at a place reasonably close to the site of the proposed plant.

i With regard to your remarks concerning work in which the Pacific Cas and Electric Company is engaged at the site of the proposed nuclear plant, I would like to point out that the Commission's regulations, while prohibiting con-struction activities which involve the permanent nuclear facility prior to the issuance of a construction permit, exempt other activities, such as site exploration. and excavation and construction of roadways, railroad spurs, non-nuclear facilities (such as turbo-generators and turbine buildings), and temporary buildings.

For the specific requirements of the Commaission's regulations, I would like to invite your attention to Section 50.10(b) of the attached Part 50.

The Commission believes that the exemption of these activities, which have no significant bearing on nuclear safety, is consistent with the pro-vision of the Atomic Energy Act which requires that the Comunission shall impose the ninimann amount of regulation consistent with its obligations to promote the common defense and security and protect the health and-safety of the public.
