Your letter of August 25, 1961, to Commissioner Haworth regarding the Commission's control over the location end design of nuclear power plants was referred to me for rep 3y.
in your letter you stated that some conservationists in California i.re alarsed by the ir:pending construction of an atomic power plant by the Pacific Gas and Electric Company at Bodega Bay which is just north of Point Reyes where the establishment of a new national seashore is contemplated.
Before a privately owned organization can obtain a license to con-struct or to operate a nuclear power plant an application must te filed with the Division of Licensing and Regulation. The Atomic Fnergy Commission's licensing authority over nuclear reactors deals primarily with protection of the public health and safety. It does

When and if an application is received
%he Commission' h 3 the Pacific Gas and Electric Company, the Covernor of the State as well as the appropriate local officials will be notified and the Commission will undertake its regulatory review. A detailed safety review of an application for a construction permit or an operating license for a nuclear power facility is made by the Commission's technical staff and by. the Advisory Committee on Reactor Safeguards. The review, among other things, includes examination of the environmental characteristics'of the site such as the geological, hydrological, 4
