Dear Mrs. Defoe:

This in in response to four letter of August 16, 1961 to the Atomic Energy Commission,, concerning the plans of the Pacific Cas andL Electric Company to' construct a nuclear power plant on Bodega Head.'

- At.the present time no appliestion for the necessary AEC license to construct and operate a nuclear power plant on Bode 8s Beed has been-1 received. from the Pacific Gas and Electric' Company, although the Consission haa'been aware for some time of the Coerpeny's' interest

In your letter, you discussed the use of Bode 6a lleed for recreational, scientific ani scenic purposes, ani the ownership of property along the Head. The Atomic Energy Comunission's licensing autbarity over -

nuclear reactors deals primarily. with protection of the public healtb j

ani safety. It does not become involved, ' therefore, in such matters -

as i.i,;. 1y rights, land acquisition and soning considerations.

j These are' considered by local and state officials and's prospective applicant normally resolves them prior to.his Jsubmittal of an appli-cation to the Atomic 1%nerEY Commission.

When sai if an applicatico~ is received by the Commission from ~ the Pacific Gaa and Electric Compemy, the Governor.of. the State as well as the appropriate local officials will be notified and the Consission will undertake its regulatory review. In order for a construc-tion permit to be granted, the results of this review must show that a proposed reactor can be operated at the site proposed without creating an. undue hasard to the health and safety of the public. ;
