EERRY NUCLEAR POWER PLANT. UNIT NO. 1 DOCKET NO. 50-440

1.0 INTRODUCTION

By letter dated May 2.1997. The Cleveland Electric Illuminating Co. (the licensee) proposed a change to the Technical Specifications (TS) for the Perry Nuclear Power Plant. The proposed change revises an existing exception to Limiting Condition for Operation (LCO) 3.0.4 as it applies to LC0 3.6.1.9 for the main steam isolation valve (MSIV) leakage control system (LCS) by making the exception permanent and clarifying that it only applies to the inboard MSIV LCS subsystem.

The LC0 3.0.4 exception was initially added to the TS by Amendment No. 63 for one operating cycle (fifth operating cycle), and was then extended for an additional cycle (sixth operating cycle) by Amendment No, 71.

It was anticipated that the MSIV LCS would be removed during the sixth refueling outage (RF06): however, the NRC has not been able to review the submittal of August 27, 1996. on a schedule that would allow such removal during RF06.

2.0 EVALUATION During RF04, the outboard MSIV before-seat drain lines were sealed off to eliminate a 3reviously unidentified and unanalyzed path for secondary containment )ypass leakage. The modification introduced a situation wherein the inboard MSIV LCS subsystem is considered inoperable in Operational Conditions 1, 2. and 3 below 50 percent power. accumulated water from condensation at l The ino Above 50 percent power the water is swept out by the velocity of the steam flow and both the outboard and inboard LCS subsystems will be operable.

There are drain connections downstream of the outboard MSIVs that will drain condensate to the condenser during power operation. Therefore, no damage to the turbine will result from any condensed water. Also. MSIV performance will not be affected by the accumulated condensation.

The action statement remains the same, requiring plant shutdown if the inoperable LCS cannot be restored within 30 days. The TS action statement allows 30 days to restore an inoperable LCS subsystem if a subsystem is discovered to be inoperable while the plant is in 0)erational Conditions 1. 2.

2 operational flexibility is not anticipated to be impacted because plant startup and power ascension from Operational Condition 3 to greater than 50 yercent power is expected to be accomplished in less than 30 days.

Therefore.

)ased on the above. the NRC staff finds that the continued LC0 3.0.4 exception for the inboard HSIV LCS subsystem only is acceptable.

3.0 S W E CONSULTATION In accordance with the Commission's regulations, the Ohio State official was notified of the proposed issuance of the amendment.

The State official had no comments.

4.0-ENVIRONMENTAL CONSIDERATION This amendment involves a change to a requirement with respect to the installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20. The staff has determined that the amendment involves no significant increase in the amounts. and no significant change in the types of any effluent that may be released offsite and that there is no significant increase in individual or cumulative occupational-radiation exposure. The Commission has previously issued a proposed finding that this amendment involves no significant hazards consideration and there has been no public comment on such finding (62 FR 33135). Accordingly this amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51,22(c)(9).

Pursuant to 10 CFR 51.22(b). no environmental im)act statement or environmental assessment need be prepared in connection wit 1 the issuance of this amendment.

5.0 CONCLUSION

The staff has concluded, based on the considerations discussed above. that:

_(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the pro)osed manner: (2) such activities will be conducted in compliance wit 1 the Commission's regulations:

and (3) the issuance of this amendment will.not be inimical to the common defense and security or to the health and safety of the public.
