CATAWBA NUCLEAR STATION - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC. DISCLOSURE (TAC NO. M72400 AND M72401)

Dear Mr. Peterson:

By letter dated August.7, 1997, Duke Power Company submitted a revision to several Catawba Emergency Plan Implementing Procedures (EPIPs). The revised EPIPs, RP/0/A/5000/02, Enclosure 4.1; RP/0/A/5000/03, Enclosure 4.1, page 2 of 2; RP/0/A/5000/04, Enclosure 4.1, page 2 of 2; RP/0/A/5000/05, Enclosure 4.1, page 2 of 2 were identified as containing privacy information (i.e., home phone numbers).

Accordingly, Duke Power marked the privacy information in its submittal. We have reviewed your submittal based on the requirements and criteria of 10 CFR 2.790 and have determined that the submitted information contains privacy information. Therefore, the privacy information so identified by Duke Power will be withheld from public disclosure pursuant to 10 CFR 2.790(a)(6) and l Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding information from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of the information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, such as, if the scope of a Freedom of Information Act request includes
