CATAWBA NUCLEAR STATION - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NO. M72400 AND M72401) v

Dear Mr. McCollum:

By letter dated December 12, 1996, Duke Power Company (DPC) submitted a revision to two Catawba Emergency Plan Implementing Procedures (EPIP). One of the revised EPIP, RP/0/B/5000/08, " Spill Response (11/22/96)," is identified-by DPC as containing privacy information (i.e., home phone numbers). DPC' i

marked the privacy information in the submittal, and we assume that DPC requested it be withheld from public disclosure pursuant to 10 CFR 2.790 of j

the Commission's regulations.

We have reviewed DPC's request based on the requirements and criteria of f

10 CFR 2.790, and have determined that the submitted information sought to be withheld contains privacy information. Therefore,'the privacy information so identified by DPC will be withheld from public disclosure pursuant to 10 CFR 2.790(a)g6) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

I Withholding information from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we maycsend copies of the information to our consultants working in this area.' We will, of course, ensure that the consultants have signed the appropriate, agreements.for' handling propriet::ry information.
