PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy Five Thousand Dollars

($75,000) will be issued on or about April 22, 1987 to Power Authority of the State of New York. This action is based on five violations involving radiation exposure protection requirements. The violations are associated with an unplanned radiation exposure on February 13,1987 of 30.27 rem in one calendar quarter to the right hand of a contractor employee.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Deputy Executive Director for Regional Operations to sign this action. The schedule of issuance and notification is:

Mailing of Notice April 22, 1987 Telephone Notification of Licensee April 22, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of New York will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
