SHEET FOR ALLEGATION NUMBERS 1230 AND 1231 FOR DIABLO CANYON, UNITS 1 AND 2 The Equipment Qualification Branch, Division of Engineering, has reviewed the information provided by the Division of Licensing in connection with Diablo Canyon Allegation Numbers 1230 and 1231. The attached Allegation Summary Sheet provides the staff evaluation and response.

We have concluded that no further action is required.

In accordance with the memo from G. W. Knighton, dated February 14, 1985, all documents used to support the resolution of Allegation Numbers 1230 and 1231 are available in the Public Document Room except for the Trip Report, dated October 23, 1981, a copy of which is also attached.

Applicability code E, as defined in the memo from G. W. Knighton, dated November 30, 1984, is assigned to these allegations.

Summary Sheet Task: Allegation or Concern Nos. 1230 and 1231 ATS No:

None None Characterization The allegations state that PG&E may have been given preferential treatment by the NRC in that they were allowed a schedule extension for compliance with the environmental qualification aspects of NUREG-0737 item II.B.2.

Commission Memorandum and Order, CLI-80-21, issued May 23, 1980, imposed a June 30, 1982 deadline for completion of environmental qualification of essential safety-related equipment.

PG&E requested and was granted an extension of this deadline until the second refueling outage.

Implied Significance to Plant Design, Construction or Operation The implication of allegations 1230/1231 is that operation of the plant without demonstrated qualification of all safety-related equipment is unsafe and would prevent the mitigation of the consequences of an accident.

Assessment of Safety Significance The staff Safety Evaluation Report for environmental qualification of electrical equipment for Diablo Canyon, was provided in NUREG-0675, Supplement 15, Safety Evaluation Report related to the operation of Diablo Canyon Nuclear Power Plant Units 1 and 2, issued September 1981. The staff found PG&E in compliance with the criteria listed in NUREG-0588 with the following exceptions:

a) PG&E must comply with the June 30, 1982 deadline imposed by CLI-80-21, b) P6&E must maintain complete and auditable environmental qualification

files, c) PG&E must notify the staff, prior to full power operation, that maintenance / surveillance procedures have been implemented.

Staff Position The environmental qualification deadlines contained in license conditions or technical specifications of operating plants were suspended by the " Interim Rule" published in the Federal Register, June 30, 1982 (47 FR28363). The

" Interim Rule" was replaced by final rule,10 CFR 50.49, effective February 22, 1983 and amended November 19, 1984. The final rule imposed a new deadline for completion of environmental qualification by the end of the second refueling outage after March 31, 1982 or by March 31, 1985, whichever is earlier. The schedules in the final rule apply to all plants and supercede any date previously imposed.

No changes to licenses or technical specifications are necessary to reflect the new completion dates.

PG&E was not given any preferential treatment. The schedule relief granted for Diablo Canyon is the same as all other reactors.

! In order to evaluate the adequacy of the corrective responses to the deficiencies identified in SSER 15, the staff conducted a follow-up audit of the PG&E qualification files for Diablo Canyon during the week of August 31 -

September 4, 1981. The staff determined from this review that the overall status of Diablo Canyon is adequate, as documented in Trip Reported dated October 23, 1981, Audit of PG&E Documentation Concerning Environmental Qualification of Electrical Equipment per NUREG-0588 for Diablo Canyon, Units 1 and 2.

Confirmation of implementation of the maintenance and surveillance progran prior to full power operation was provided by PG&E by letter DCL-84-201 dated June 5,1984 and letter DCL-85-065 dated February 15, 1985.

Action Required None. The staff considers these allegations resolved.
