NUCLEAR SUPPLIERS MEETING

Purpose:

To inform the Commission of the results '

of the meeting held in London, England, on March 31, 1976, of the Physical Protecti'on Subgroup of the Nuclear Suppliers Committee.

Discussion: SECY-76-158 dated March 19, 1976, informed

.the Commission of the planned meeting of the Physical Protection Subgroup of the Nuclear Suppliers Committee and requested guidance on U.S. efforts directed toward the setting of levels of physical protection fcr special nuclear material (SNM) exported by supplier nations. The Commission favored Alternative'2 of that paper and directed ,

the staff to support the establishment of international physical protection requirements ,

that are compatible with present NRC require- l ments in Part 73. With respect to physicai l protection for quantities of SNM not covered i by Part 73, the Commission favored a position of graded levels of protection consistent with the threat and potential risk involvec l without specifying the kinds and quantities of material to be protected or the requireo ' {

l The Commissioners The document ultimately approved at the meeting (Enclosure 5) represents a balance between the U.S. and French papers and re-flects views of the other nations represented at the meeting. The approved paper contains a categorization of nuclear materials which I should be protected and specifies generally the level of protection to be ensured. This approved text will be submitted for considera-tion at the next meeting of the Nuclear Suppliers Group.

As a rule, categories ,I, II andIII shall determine the choice of levels I, II and III.

4.2. Proceeding on this basis, an exact assessment of the potential threat shall be made, taking into account all relevant facts and the requirements in each individual case. In exceptional cases this evaluation may result in a level of physical protection for a given category of material different from tha standard level persuant to paragraph 3.1. above.

~5. The responsibility for the establishment implementation and maintenance of an effective physical protection system, including assessments and decisions to be made in accordance with paragraph 3.2. above, shall be borne exclusively by the

Governments of the recip1ent states, which shall also foresee penal sanctions as a supporting means for enforcing the preventive physical protection system.

1 PROPOSED DEFINITIONS FOR THE CATEGORIES

. National ordors, established by responsible public authorities, I should anticioate at the very least the following protection standards:

1 l Category I -

  • Use and storage in an inside area situated (itself) within a protected zone for which admittance is limited to persons previously qualified and being subjected to particular surveillance by the Public Authority.

  • Transport under permanent custody (guarding), af ter previous t

-authorization, in communication with responsible public authorities l in order to be able to intervene in case of need.

Category II

  • Use and storage in a protected area, i.e., subject to permanent i 1

surveillance (by guard or electronic devices) surrounded by a '

physical barrier with a limited number of access points, controlled and protected, and approved after a security inspection. i

  • Transport, subject to particular precautions, especially in accordance with previous agreement with the sender, deceiver and

. transporter. Previous agreement among countries, in case of international shipments, prescribing the place, time and the mode of responsible transfer.

Category III

  • Use and storage in areas where access is subject to control.

THE MEMBERS OF THE SUB-GROUP ON PHYSICAL PROTECTION OF THE NUCLEAR SUPPLIERS GROUP Attached is a copy of the draft document entitled

" Criteria for Levels of Physical Protection" prepared by the Physical . Protection Sub-Group on March 31, 1976.

It is my understanding that the text has been agreed ad referendum with the following exceptions / reservations:

1. Some of the delegations wished to reserve their position on the last sentence of paragraph 2 concerning the applicability of physical protection requirements to nuclear weapon states, pending further review within their governments. This sentence therefore appears in brackets. .
2. The United States Delegation preferred that irradiated fuel with low fissile content be placed in Category II rather than Category III, and wished to reserve its position on this matter, pendin'g further review within its government. The appropriate reference to this type of fuel in the attached Table therefore appears in brackets.
3. The Japanese Delegation wishad to reserve its position on the levels of protectivn to be ensured in transportation of protected materials which appear in paragraph 5, pending further review within its government.
4. The French Delegation wished to reserve its position on the lower values for nuclear materials appearing in Category III of the attached Table and intends to provide revised values for future consideration by the working group.

The U.S. Delegation, after further consideration of entire text, believes that the concept of prevention of unauthorized use through prompt initiation of recovery operations is covered within the text and therefore with-draws its request for explicit language to that effect in the text of paragraph 5. '

DRAFT Criteria for Levels of Physical Protection

1. The purpose of physical protection of nuclear materials is to prevent unauthorized use and handling of these materials. Paragraph 3 (a) of the Guidelines document calls for agreement among suppliers on the levels of protection to be ensured in relation to the type of materials, and equipment and fa 41ities containing these materials, taking account of inter. tional recommendations.
2. Paragraph 3 (b) of the Guidelines document states that implementation of measures of physical protection in the recipient country is the responsibility of the Government of that country. However, the levels of physical protection on which these measures have to be based should be the subject of an agreement between supplier and recipient. {In this context no distinction shall be made between nuclear weapon states and non-nuclear weapon states.}
3. The document INFCIRC/225 of the International Atomic Energy Agency entitled "The Physical Protection of Nuclear Material" and similar documents which from time

' to time are prepared by international groups of experts and updated as' appropriate to account for changes in the state of the art and state of knowledge with regard to physical protection of nuclear material are a useful basis for guiding recipient states in designing a system of physical protection measures and procedures.

The categorization of nuclear material presented, in the attached table or as it may be updated from time to time by mutual agreement of suppliers shall serve as the agreed basis for designating specific levels of physical protection in relation to the type of materials, and equipment and facilities containing these materials, pursuant to paragraph 3 (a) and 3 (b) of the Guidelines document.

5. The agreed levels of physical protection to be ensured 1 by the competent national authorities in the use, storage and transportation of the materials of the attached table (

shall as a minimum include protection characteristics as follows: {

CATEGORY III_ i Use and Storage within an area to which access is controlled.

i Transportation under special precautions including prior l arrangement between sender, recipient and carrier, and prior agreement between states in case of international transport specifying time, place and' procedures for transferring transport responsibility.

CATEGORY II ~

Use and Storage within a protected area to which access is controlled, i.e., an area under constant surveillance by i guards or electronic devices, surrounded by a physical barrier l with a limited number of points of entry under appropriate l control, or any area with an equivalent level of physical '

protection.

Transportation under special precautions including prior l arrangement between sender, recipient'and carrier, and prior agreement between states in case of international transport specifying time, place and procedures for transferring transport responsibility.

l CATEGORY I Materials in this Category shall be protected with highly '

reliable systems against unauthorized use as follows:

n J guards who are in close communication with appropriate response forces. Specific incasures taken in this context shou 1(' have as their objective the detection and prevention of any assault, unauthorized access or unauthorized removal of material.

Transportation under special precautions as identified above for transportation of Category II and III materials and, in addition, under constant surveillance of escorts and under conditions which assure close communication with appropriate response forces.

6. Suppliers should request identification by recipients of those agencies or authorities having responsibility for ensuring that levels of protection are adequately met and having responsibility for internally coordinating response / recovery operations in the event of unauthorized use or handling of protected materials. , Suppliers and recipients should also designate points of contact within their national authorities to cooperate on matters of out-of-country transportation and other matters of mutual concern.
