SUBJECT:

NUCLEAR SUPPLIERS CONFERENCE The Nuclear Suppliers Group met in London on June 3-4. (State Department l summary of the meeting, delegation list, and agenda are at Tabs A, B, and C respectively.)

In brief, the major results of the conference were:

Adoption of the criteria for levels of physical protection to be applied to exports of special nuclear materials (see Tab D and the discussion below);

Agreement to avoid publication of any of the guidelines at least until after the review meeting in November, to invite Switzerland and Poland to join the Group, to initiate steps to have the Zangger Committee " trigger list" brought into conformity with the London

" trigger list," and to preserve the confidentiality of the London meetings and guidelines in discussions with other countries; and Establishment of a working group (chaired by Canada) to coordinate and exchange views on multinational fuel cycle centers and possible

" internationalization" of plutonium stcrage under the IAEA. (U.S.

papers on plutonium management issues, at Tab E, were distributed as a starting point for exploratory discussion.)

Of particular interest to the NRC is the adoption, as minimum standards, of the criteria for levels of physical protection on exports of special nuclear materials (Tab D). ,~ l l NRC requirements in Part 73, the second and third categories specify l minimum levels of protection for kinds and lower quantities of special l nuclear materials not ec , 'd by NRC regulation. NMSS has been assess-ing the impact and cost vi the lower limits criteria and expects to forward a report for the Commission's consideration within a month.

l Pending completion of this review and development of our regulations, l we cannot say whether or not there will be any important inconsistencies between the physical security criteria adopted in London as export con-ditions and our domestic regulatory requirements. I forewarned the U.S.

delegation of the potential for problems depending upon the impact, cost, and other analyses associated with our review of the lower limits cri-teria.

Although the other members of the U.S. delegation did ndt deem it advisable explicitly to qualify U.S. support for adoption of the physical security criteria (for example, by agreement in principle at this stage}.

the statement favoring adoption also noted that the criteria are being reviewed by the NRC with a view toward establishing appropriate standards.

If any significant problems or inconsistencies were to emerge in this connection, we would then have the opportunity to suggest that they be raised at the November review meeting of the London Suppliers Group at least for purposes of explaining why we reached different conclusions -

for our regulatory requirements.
