Dear Myron:

Following on my letter of December 8, the Commission has reviewed the State Department's view regarding continued nuclear exports to the non-nuclear-weapon EURATOM countries and would appreciate an early l

response to the following questions:

1.

Would the United States be in both strict and material compliance with its obligations under Article III(2) of the NPT if it continues to supply EURATOM countries before the IAEA-EURATOM safeguards agree-ment comes into force?

2.

If not, what are the consequences of continued supply vis-a-vis rights or views and/or reactions of other parties and nonparties to the NPT?

3.

What would be the consequences of insisting on having the IAEA-EURATOM safeguards agreement in force before further U.S. supply?

4.

In light of the Department's judgment that the IAEA-EURATOM safeguards matter would have to be reassessed if the agreement were unlikely to come into force.in the relarively near future, when does the Depart =ent anticipate res'olution of tL safeguards agreement issue in EURATOM?

5.

What representations has the U.S. made to EURATOM countries on the is-sues arising from the failure to bring the IAEA safeguards agreement into force? What future representations are planned?

6. ;Which other countries, if any, are continuing to supply nuclear ma-l terial and/or equipment to EURATOM countries? 'lias the matter been su issue with any countries outside EURATOM? Do we know the views of other countries on this matter?
