PROPOSED CHANGES TO THE STANDARD TECHNICAL SPECIFICATIONS ON FIRE PROTECTION We have reviewed the proposed STS on fire protection transmitted by your memorandum of December 7,1984 and cur coments are in the enclosure. In general we believe that the proposed STS are a significant improvement ever previous drafts, and will provide reasonable assurance that fire prevention /
protection equipment will protect safety related equipment throughcut the lifetime of the plant.
We have reviewed the draf t Working Group memorandum to the Steering Comittee in your Erclosure 2 and have no substantive coments.

I would suggest deletion of the proposed additien to the footnote on Table 3.3-11, and the addition of a

clarifying statement to the the action statement of 3.7.11.2,

.4 to state that for only a Function B detector inoperable the action stater.ent of 3.3.3.8 is applicable.

Bases 3/4.7.11 - There has been some confusion over the definition of an acceptable backup pump or supply required by 3.7.11.1, We recocrend that the bases state that an acceptable backup pump or supply is one that will:
(a) Meet the maximum fire suppression system dem.and plus hose streams.
(b) Not otherwise affect the nuclear safety of the plant when in use.

3.7.11.6 Action a.
This spec is more restrictive than 3.7.11.5 Action a as rewritten for no apparent reason. It is suggested that the action statement be rewritten to be the same as 3.7.11.5 Action a.

3.7.12 The applicability should be whenever equipment separated by the fire rated assemblies is required to be operable.

The Tech Spec numbering sequence was developed as follows: Section 3.X.Y is t.he set of LCOs for system X and subsystem Y. Section 4.X.Y is the sWeillance requirements for the same system and subsystem. They are combined into section 3/4 so that the LCOs and surveillance requirements would appear together for each subsystem.
Section B_ 3/4.X.Y is the "bases" and provides the background for the LCOs and surveillance for that subsystem; they are not specs and are intended to be philosophical. The specific section you referred to is in the bases.

REC 0KMENDED FIRE PROTECTION POLICY AND PROGRAM ACTIONS We have reviewed the recomendations of the Fire Protection. Policy Steering Committee as requested in Mr. Dircks' memorandum of Noverter 2,1984. We

believe the Steering Comittee's three main recomendations dealing with (1) guidance to the industry, (2) expedited inspections, and (3) upgrading of regulatory documents to ensure consistency provide a sound basis for moving l
forward in the fire protection area.
I believe the benefits from moving quickly to clear up the cloud of uncertainty that hangs over the fire protection area outweigh any gains to be made by delaying while we attempt to l
resolve remaining disagreements.
In that spirit we have the following coments:

r; In response to the EDO memorandum of November 2. I have reviewed the subject report personally. As you know, my office was represented on both the Steering Comittee and the Working Group. Bill Shields'of the Regulations Division participated in the development of the report itself and the recomendations contained therein.
I believe the recomendations contained in the report are legally sound and sensible from a policy standpoint. The fire protection issue has consumed an
~
extraordinary share of agency resources, both technical and legal. While the (N
suggested program would have some imediate resource impacts, such an investment is probably necessary to bring the matter to resolution in the shortest possible time. I would note that in adopting the policy of not granting further schedular exeeptions, consideration will be needed of our regulatory response to the expected violations. In regard to the draf t enforcement policy, I would suggest that the second sentence of 2.C (containing "prima facie") be moved to the "General Guidance" section and be modified to read as follows: "The NRC intends to initiate enforcement action where, for a given fire area, compliance with Appendix R is not readily demonstrable and the licensee does not have available a written evalustion for the area." A confonning change would need to be made to the proposed
