ENCLOSURE 1 NOTICE OF VIOLATION General Atomics Docket No.: 70-734 1 San Diego, Califomia License No.: SNM-696 1 During an NRC inspection conducted on November 3-7,1997, one violation of NRC requirements was identified. In accorriance with the " General Statement of Policy and Procedure for NPC Enforcement Actions," NUREG-1600, the violation is listed below:

Safety Condition S-23 of SNM License 696 requires the licensee to maintain and execute the response measures described in the Emergency Plan [ Radiological Contingency PI '.n] dated August 1995 and revisions thereto.

Section 10.1, " Written Procedures," of the licensee's Radiolog'. cal Contingency Plan states, in part, that emergency procedures detailing the actions to be taken to implement this emergency plan will be prepared for each facility covered by the plan.

Section 11.2, " Fire in contaminated areas of HCF," of the Hot Cell Facility (HCF)

Emerge .cy Response Procedure No. HCP-4.0 states, in part, "The proper response to a radiologically-related fire at the HCF is as follows:

11.2.1 Activate the fire alarm .... and evacuate peisonnel from the HCF.'

Contrary to the above, on November 3,1997, the fire alarm at the HCF was not activated when personnel became aware of an ongoing fire within the facility.

This is a Severity Level IV violation (Supplement Vill).

Pursuant to the provisions of 10 CFR 2.201, General Atomics is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and the Walnut Creek Field Office, 1450 Maria Lane, Suite 300, Walnut Creek, Califomia 94596, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a

" Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
