Dear Mr. Chairman:

This responds to your letter of June 26, 1984. In that letter, you indicated that you plan to release the NRC staff's draft answers to the questions in your letter of March 13, 1984, concerning the Grand Gulf nuclear power station.

Your original request for information contained eleven questions, some with as many as seven separate parts, as well as a broad re-quest for staff documents. In order to inform you as promptly as possible, the Comission chose to have our Executive Director for Operations forward the NRC staff's draft answers to your questions; however, because of the depth of your request and due to other pressing Coanission business, we have not yet fully considered the staff draft nor have we taken collegial action on it.

The staff draft constitutes the advice and opinions of the staff on how the Cosnission should respond to your request. At this point, it is predecisional and, in order to facilitate the proper conduct of agency business, Congress provided that it could be withheld from the public under the Freedom of Infomation Act. The Cocaission believes it would be confusing for the public if the staff's draft response was released at the very time that the Comission was I reviewing it in order to develop a Comission response.

We provided the NRC staff's draft response to you with the under-standing that it was not available to the public and that its use l would be restricted to the members and staff of the Subconnittee, i We urge, therefore, that you not make it public at this time. The i Conaission does not object to your release of the documents in En-closure 2 of Mr. Dircks' letter dated June 4,1984 which forwarded the staff's draft answers to you.

The public interests would be better served by releasing the staff responses, especially in light of the fact that the same arguments have been used to justify the restart of the Grand Gulf plant.

I regret to have to add that in holding up its reply for three months, the Comission has failed to discharge its obligations to keep the Congress fully and currently infomed. It is unfortunate that Congressional review of the serious safety issues in this case has been delayed. It may now come too late.

I believe that, since the Comission is trying to review and develop a response based on the same infomation already provided to you, the Co=ission has not failed to keep the Congress fully and currently informd. The subject of this letter has to do with whether or not the preliminary material already sent to you should be released to the public.

We expect to have the Comission's response to you by mid-July. At that time, we will infom you of any items that should continue to be withheld from the public.
