SUBJECT:

SAFEGUARDS REGULATORY EFFECTIVENESS REVIEW OF KEWAUNEE NUCLEAR POWER STATION This is in response to your June 28 memo, and confirms our understanding reached at our meeting on July 9, namely:

1.

You will revise the draft letter to Kewaunee to remove tbe thought that a Safeguards Regulato'ry Effectiveness Review (RER) is " independent" of NRC's licensing and inspection functions.

2.

I will support your efforts to o'btain liEensee cooperation for two RER's in FY 82.

3.

You will provide clarification of the purpose of the overall program.

That is, is it aimed at evaluating the effectiveness of existing regulations (in which case, only a sampling of plants would be needed), or is it a more general QA-type check on security at reactors (in which case, all plants would be visited)?

In connection with item 2, we have contacted the Kewaunee licensee regard-ing a possible visit in July.

We were informed that they cannot acconinodate such a visit until sometime in October. They further expressed some reser-vations about the program and its potential adverse impact on them. They agreed to view the audio-visual you have prepared and suggest that a showing of it at the site woula be more effective. As you have requested, we are making' arrangements for such a. visit.
