E00-9393 It gives me great pleasure to respond to your inquiry dated July 2,1980 in which you enclosed a copy of a letter from Mr. Ed. Borhek. Mr. Borhek expressed concern about who ultimately bears the burden of civil penalties as it relates to the proposed imposition of civil penalties against Wash-ington Public Power Supply System.

As you know, the civil penalty is a tool in the NRC enforcement program, the purpose of which is to protect the health and safety of the public, the comon defense and security, and the environment.
The enforcement program emphasizes corrective action, where necessary, to assure that regulated activities meet applicable requirements.
On those occasions when licensees do not egnply with regulatory requirements, enforcement action is taken comensurate wTe ' the seriousness of the item (s) of noncompliance. This was the case most cen'tly with WPPSS. On June 17, 1980, NRC notified WPPSS of the proposed imposition 'of civil penalties totaling $61,000 for identified deficiencies in the quality assurance program.
On July 16, 1980, the licensee responded to NRC's notice, as provided,for in our procedures. That response is currently being reviewed by the staff.to' ldetermine whether mitigation of the proposed civil penalty is uarranted. When that review is concluded, a decision will be made regarding mitigation. After all these elements have been carefully examined an appropriate order will be issued.
If an order imposing civil penalties is issued, the licensee has the right to appeal this imposition g N7 order.

,To further respond to Mr. Borhek's concern about who ultimately bears the burden of civil penalties, this is a matter outside of NRC's safety responsibility.
W The States and their agencies, such as Public Utility Corm:issions, are responsible g 3, and properly concern,themselves with such matters.
