APPLICANTS' REVISED RESPONSE TO INTERROGATORY NO.15AA(2d)-19(h) ON CONTENTION 15AA On December 20, 1983, Applicants Carolina Power & Light Company and North Carolina Eastern Municipal Power . Agency filed Applicants' Further Interrogatory Responses on Eddleman Contention 15 AA, which responded to Interrogatory No.

15AA(2d)-19(h), among others. At the request of Mr. Eddleman and to avoid any further discovery dispute, Applicants have agreed to expand their response to this interrogatory as follows:

INTERROG ATORY NO.15AA((2d)-19(h). Please give all basis for your answers to (d), (e) . . ., stating which basis applies to each answer.

ANSWER: Interrogatory Nos.15 AA(2d)-19(d) and 15AA(2d)-19(e) call for a legal "

analysis and conclusion. Applicants' answers are based upon their interpretation of Chapter 62 of the North Carolina General Statutes. With respect to Interrogatory No. '

15AA(2d)-19(d), the basis for Applicants' answer is set forth in greater detail in CP&L's Brief (filed September.1,1982) and Proposed Order (filed September 7,1982) in NCUC Docket No. E-2, Sub 444. With respect to Interrogatory No.15 AA(2d)-19(e), the answer is based upon CP&L's position that the cost of regulatory compliance in connection with the 1982 Brunswick shutdown should have been recognized as a normal cost of doing busiro. s in setting CPaL's rates. Commission's order in Docket No. E-2, Sub 444; CP&L elected to file an application for a new rate order instead. The time for appeal of the order in Docket No. E-2, Sub 461 has not expired. CP&L has not yet appealed this order; the status of any appeal by other parties is uncertain.
