APPLICATION FOR SUBPOENA In preparing testimony to respond to contention V-3a, Applicant, Philadelphia Electric Company 'has requested representatives of ARCO Pipe Line Company (" ARCO") to prepare written responses to certain questions relating to the design, construction and operation of the ARCO pipe line which passes near the Limerick Generating Station. While it was understood that the representative of ARCO would be subpoenaed to testify at the hearing, Applicant learned today that ARCO also required a subpoena for the release of any proposed written testimony. In order to accommodate this request, Applicant applies to the Atomic Safety and Licensing Board for issuance of the attached subpoena.

Inasmuch as a telephone call to the Board's secretary earlier today determined that the specific location of the evidentiary hearing has not yet been confirmed, the subpoena is general as to its place of return.

District Manager, ARCO Pipe Line Company, the answers to which would constitute the proposed testimony, are attached and become part of the subpoena. /

For the above stated reasons, the attached subpoena should be issued.

Inasmuch as Appl 3 cant cannot require the preparation of written testimony by an independent company, Applicant does not believe that such written prefiled testimony is required under the Commission's rules. However, in order to assist the Licensing Board and parties, the Company is attempting to have ARCO Pipe Line Company voluntarily submit this proposed testimony in advance.

In any case, ARCO representatives will testify as to the factual circumstances regarding its ownership, design, construction and operation of this pipe line.
