In support of this application, Del-AWARE states that Gerald M.

! Hansler may provide Del-AWARE with testimony relevant to the conten-tions of Del-AWARE admitted for adjudication in this proceeding.

Specifically, Gerald M. Hansler can provide testimony relating to the flow in the Delaware River, the operations of the Point Pleasant in-ta'ke and the likely effects of the proposed management plan on the l

Delaware River on flows at the intake. Information about the river 8208110186 820809 PDR ADOCK 050003S2 G PDR

r flow and intake operation is crucial to evaluation of the effects of the intake on aquatic life and recreation in the vicinity of the in-take. In addition, Gerald M. Hansler can testify as to the practice of the Delaware River Basin Commission regarding waiver of intake withdrawal restrictions during emergencies.

WHEREFORE, Del-AWARE respectfully requests that its Application for Issuance of A Subpoena be granted and that the Board issue the attached subpoena to Gerald M. Hansler.
