POLICY STATEMENT ON EXEMPTIONS FROM REGULATORY CONTROL

.NHSS believes that the encloseo draft paper dated November 8, 1989, meets the specifications of the CNunission's SRM concerning exemptions dated October 13, 1989. Accordingly, we concur in-the paper as having met the Comission's requirements,. subject to resolution of the following:

Editorial consents on the enclosed marked up draf t.

2.

Incluaing a more clear statenient as to NRC and Agreement State jurisdiction in the application of the policy. NRC retains exclusive jurisdiction over consumer products. Both apply the policy to waste disposal and deconsnissioning. Recycle is an open issue since it will involve the introduction of contaminated materials into consumer products, which will have national and international distribution.

If the recycle. issue cannot be resolved at this stage, the issue should at-least be noted for the L

Comission.

We also suggest that the Comission be informed of status of BEIR V.
