SCHEDULE FOR DEVELOPMENT OF A-COMMISSION EXEMPTION (BELOW REGULATORY CONCERN) POLICY
Background:
On September 9, 1988, the staff submitted, in SECY-88-257, a proposed Comission policy statement on exemptions from regulatory control for practices whose public health and safety impacts are below regulatory concern (BRC). The associated staff requirements memoranda (SRM), dated September 29 and 30, 1988, provided the staff with a modified draft Advance Notice of the policy statement, instructions for the international workshop subsequently held in October, and instructions for other, as yet unplanned, public workshops.
The SRM also included a January 27,,1989 SECY suspense date for submission of a Federal Register Notice containing a revised proposed policy for Comission review. The purpose of this paper is to outline a revised schedule for achieving this-objective which would involve (1) the convening of the public-meeting; (2) consideration of comments from that meeting, from the international workshop, and from written coments submitted on the Advance Notice which would be published in the Federal Register;.(3) coordination within the staff; and (4) development of a new proposed policy statement to be submitted to the l
Comission by April 28, 1989.

' Discussion:
The staff believes that one-public meeting should be sufficient at this point in formulating a proposed broad Comission exemption policy since another opportunity for public participation would be provided when the proposed policy statement is published for public comment.
The schedule for the public meeting and subsequent staff consideration of public input is enclosed. The public meeting would be for one day and would include an NRC staff panel to introduce the Comission's " Advance Notice of a Comission Policy on Exemptions from Regulatory Control", and to i

-of-the public meeting;-however, the workshop notebook containing the formal papers and the transcript of the meeting would be made available for public inspection through the a
public document room prior.to the publication of.the Comission's Advance Notice in the Federal Register. The public would be invited to ask questions and make statements on the-Advanced Notice, in particular, or on exemption policy, in general. The meeting would have a written agenda to assure 1
that each issue in the Advance Notice is discussed. Persons who wish to speak would be asked to register prior to the-meeting so the times could be adjusted to accomodate, as a minimum, all registered speakers.
Subsequent to the public meeting, written comments would also be accepted to accommodate those who could not attend the meeting or who had additional comments based on information they had obtained at the meeting.
