On June 26, 1989, the Nuclear Management and Resources Council (NUMARC) briefed a
the NRC staff on the expected content of a petition it is preparing to have i
specific reactor waste streams designated as Below Regulatory Concern (BRC).
The purpose of this briefing was to provide an overview of the petition which is expected to be submitted to NRC in the July / August 1989 timeframe. The aseting agenda (Attachment A) and list of participants (Attachment B) are l
endosed.
. DISCUSSION: reparing this petition with support from Electric Power Research NUMARC is p(EPRI) and Edison Electric Institute (EEI) on behalf of 54 nuclear Institute
- utilities. The potential BRC waste addressed in the petition represent 20 to 30 percent of the vulume and.018 percent of the activity of all LLW generated by commercial reactors. The various wastes considered are grouped as one waste stream with certain bounding physical and radiological properties. The characteristics of the waste discussed in this petition are representative of -
all commercial reactors with the exception of TMI-2 and Fort Saint Vrain.
Waste from these two facilities have unique characteristics and are therefore not covered by this petition.
However, NUMARC indicated thet some TMI-2 and Fort Saint Vrain waste may be considered BRC waste under the proposed rulef that result from the-petition if a case may be made to justify that position.
NUMARC. indicated that the petition is organized in three parts: the petition itself, and tuo httachments. The information contained in the petition is organized under the following headings: introduction; regulatory requirements; decision criteria; the proposed rule;. environmental analysis; regulatory analysis; economic impact on ses11 entities; and the Paperwork Reduction Act.
The first attachment will contain the technical justification for the petition, and the second attachment will contain 14 separate EPRI reports which document
.the research effort in support of the petition.
The proposed rule in the petition is expected to require amendments to 10 CFR Part 20. Changes to other parts in 10 CFR are not anticipated. NLMAkC stated that waste streams with the potential for recycle would not qualify as BRC waste under this petition.
In addition, NUMARC added that the imp $ct of designating waste as BRC is expected to result in a dose of 15 millirems per

In the course of this meeting, NUMARC requestad that NRC staff provide the following information: (1)ManualChapter0230"CollectionsofInformationand Reports Management's (2) Agreesent States address listing; (3) a copy of the State of Texas regulations addressing specific waste exemptions "TRCR Part 21";
(4) any) format requirements for the submittal of petition data on floppy disks; and (5 the number of copies of the petition requested for NRC use. The NRC staffwillcollectandforwardthisinformationtoNUMARC.
