COMMISSION PAPER AND PROPOSED POLICY STATEMENT ON EXEMPTIONS FROMREGULATORYCONTROL(BELOWREGULATORYCONCERN)

As we agreed in yesterday's conversation, the subject Comission paper is being forwarded for your consideration. The paper includes, as Enclosure 2, a proposed Comission policy statement on Exemptions from Regulatory Control for

' Practices whose Public Health and Safety Impacts are Below kegulatory Concern.

The proposed policy is based on principles and technical considerations developed over the last few months by an interoffice working group and includes numerical critera for demonstration of ALARA in the exemption decision-making process. The numerical criteria are those discussed during the interoffice meeting with you on August 31, 1988.

The Comission paper acknowledges the difference in views held by the Office of Nuclear Material Safety and Safeguards regarding the, numerical criterion on individual dose and includes as an attachment their memorandum to you which i

describes their position.

I believe, as you, that the areas of consensus reached by the interoffice working group as well as the HMSS difference in views regarding the numerical crf terion should be the subject for Comission consideration.

This Comission paper is being transmitted to the ACNW as a prederf tional document.
