SUBJECT:
CONSTRUCTION SITE NONCOMPLIANCE DATA FOR THE PERIOD 1976 THROUGH 1980 A portion of the 766 system noncompliance data for the subject period is graphically summarized in the enclosed attachments. This summary is provided for Beneral information and is an initial attempt to identify key licensee perforraance indicators. The five year time frame was chosen for the following reasons:
(1)
The 1981 noncompliance data base is not complete due to outstanding inspection reports.
(2)
A period prior to the Zimmer investigation was chosen to determine if there are any indicators that would identify similar problems at other sites.
(3)
A five year period provides a large data base for determining a respresentative average.
Attachment (1) is the total number of noncompliances for the 16 non-operational units in Region III. Zimmer, LaSalle 1 Midland 1 & 2, Perry 1 & 2 Fermi 2, and Callaway are above average in this area. The number of Zimmer noncot pliances was 64 percent above average.
Attachment (2) depicts the Appendix B noncompliance frequency distribution for the 16 units during the five year period.
Criterion V, Instructions, Procedures, and Drawings, is used for a major portion of noncompliances.
Criterion XI, Test Control, had the lowest frequency.
Attachments (3) through (21) further break down the attachment (2) data by comparing each unit to the average frequency by criterion. High frequencies may indicate where specific problem areas were during the period. Low frequen-clus may indicate good performance or that more inspector attentien is required.
j If normal is defined as those-units whose noncompliance frequencies were within one standard deviation from the average frequency, the units may-be ranked by subtracting the number of criteria where the frequency was aboveinormal from the number of criteris,where the frequency was below normal for each unit. The lower rankings may indicate poorer overall performance. The following is the result of this process:

-3 Conclusions from this data are hard to pinpoint due to such factors as facility percent completion, individual inspector methods, and the total number of inspector hours per unit. However, the enclosed information may be useful to personnel who are more familiar with the specific units.

This letter is in response to the Notice of Violation letter dated December 18, 1981 signed by Mr. D. G. Wiedeman. The notice is a result of the inspections conducted by Mr. D. R. Gibbons (Region III) and Mr. J. Nicolosi (Region I).
Pursuant to 10 CFR 2. 201, the following details our actions regarding the Severity Level VI violation:
Item:
10 CFR 34.43(c) requires that a record of the survey required by 10 CFR 34.43(b) be maintained for two years when the survey is the last survey prior to locking the exposure device and ending direct surveillance of the operation.
Contrary to this requirement, it was learned through review of records during inspections at your Milwaukee, Wisconsin; Cincinnati, Cleveland and Perry, Ohio: and Madison Heights, Michigan facilities, that you have failed to maintain records of the last survey of your radiographic exposure devices prior to locking the device and ending direct surveillance of your field operations.
This is a Severity Level VI violation (Supplement VII).

This refers to the routine safety inspections conducted by Mr. D. R. Gibbons of this office and Mr. J. Nicolosi of our Region I office during the period of March 24, 1981 through December 8, 1981, of activities authorized by NRC Byproduct Material License No. 12-00622-07 at the following locations:
Madison Heights, Michigan; Perry, Cincinnati and Cleveland, Ohio; Pittsburgh and Monongahela, Pennsylvania, and Milwaukee, Wisconsin and to the discussion of our findings with members of your staff at the conclusion of each of the inspections, and to a telephone conversation between Mr. D. R. Gibbons and Mr. E. Banfield on December 17, 1981.
The inspections were an examination of activities conducted under your license as they relate to radiation safety and to compliance with the Commission's rules and regulations and with the conditions of your license. The inspec-tions consisted of a selective examination of procedures and representative records, observations, independent measurements, and interviews with personnel.
In addition to the above areas, the inspectors examined actions described in your letter dated September 27, 1979, regarding apparent items of non-compliance found during inspe: tion of your facilities at Bridgeville, Pittsburgh and Trevose, Pennsylvania; Milwaukee and Pleasant Praire, Wisconsin; Cleveland, Ohio; Roseville, Minnesota; and Hancocks Bridge, New Jersey. Our inspectors also examined action described in your letter dated July 29, 1980, regarding items of noncompliance four.d during our July 2, 3 and 25, 1980 investigation at your Springdale, Ohio facility.
We have no further questions regarding these matters.
During these inspections, certain of your activities appeared to be in non-compliance with NRC requirements, as specified in the enclosed Appendix.
A written response, submitted under oath or affirmation, is required.
