On November 29, 2019, NextEra filed an unopposed motion seeking an extension of time to file for leave to submit responsive proposed findings of fact and conclusions of law.

NextEra states that any such motion will be accompanied by the responsive proposed findings and conclusions themselves.1 Under 10 C.F.R. § 2.323(a)(2), parties must submit motions to the Board no later than ten (10) days after the occurrence or circumstance from which the motion arises.2 The deadline to file the motion for leave is currently December 2, 2019.

NextEra requests an extension to December 6, 2019, and C-10 requests an extension to December 13, 2019.

Finding the requested extension reasonable given the recent holiday schedule and the complexity of the case, the Board grants the requested time extension. The parties shall file 1 NextEras Unopposed Motion for Extension of Time to Seek Leave to File Responsive Proposed Findings of Fact and Conclusions of Law (Nov. 29, 2019).

any motion seeking leave to file responsive proposed findings of fact and conclusions of law on or before Friday, December 13, 2019. Any such motion shall be accompanied by the responsive proposed findings of fact and conclusions of law the party seeks leave to file.
