DOW MEMORANDUM IN OPPOSITION TO SAGINAW MOTION TO RECALL The sole stated factual basis for the SAGINAW Motion to Recall is the allegedly newly discovered evi-dence (in late December, 1372) of the Ilearing Board Chair-man's Columbia Law Review article, As the Dow opposing affidavit makes clear, the a

Irrespective of the knowledge of.the single , attorney involved, (a) other SAGINAW.or MAPLETON counsel or their clients undoubtedly had long ,

- . ,'knownc'of the article;~and ~;

(b) even this attorney :as well as the others (including EDF) and their clients, (i) had undoubtedly known of the substance of the views ex-pressed in the Columbia Law Review article in its earlier version; and (ii) from the inception had also kncun the Chairman's views as exprenced in other scholarly works which he had uritten and from connents during the IIcaring herein itself.

- Accordingly, even if the AEC rules justified the present notion, the failure to make timely application based on the Columbia Lau Revieu article is inexcusabic and is alone a sufficient basis on which to reject the SACINAU motion. Safeway Stores. Inc. v. FTC, 366 F.2d 795 (9th Cir. 1966), cert. denied, 386 U.S. 932 (1967);

Gilligan, Will.& Co. v. SEC, 267 F.2d 461 (2d Cir.), cert.

The SAGINAW 1egal contention that a part-time . __

The final SAGINAW charge (that the Chairman and the other Members of the Board were personally prejudiced i

against' Opposing Intervenors), flies in the face of the mass of contrary evidence in the record. The quotations submitted by SAGINAN are taken out of context, and are largely responsive to Intervenors' own requests and conduct.

CONCLUSION The SAGINAW motion is without foundation in law or fact. Although the temptation may be to cross-examine the SAGINAW affidavit to inquire into the knowledge of all Opposing Intervenors' counsel and their citents (such.as

we hope the Bo'ard vill dispose of the application,without '.]~

steps which might delay progress of the appeal on its way to ultimate final proper adjudication on the =erits.
