LICENSEE'S MOTION FOR EXTENSION OF TIME Licensee has received'from John Leithauser a letter to the NRC Commissioners, a " Belated Motion For Leave to File Pleading Out of Time," and a set of proposed con-tentions apparently mailed on December 15, 1979. Under the NRC's rules of practice Licensee would normally be allowed until January 2, 1980 to respond to these filings. Licensees' attorneys and its employees having knowledge of the facts concerning this application have long-standing prior holiday commitments for the week between Christmas and New Years which would make it difficult for them to consult and prepare and submit an adequate response in that time frame.

Accordingly, Licensee respectfully requests a one week 1731 221 8 0 01100 3M Cr

extension of time to respond to Mr. Leithauser's filings; that is, until January 8, 1979.

Respectfully submitted, b'
