SUMMARY

OF MAY 8, 2019, TELECONFERENCE WITH NORTHERN STATES POWER COMPANY, DOING BUSINESS AS XCEL ENERGY, TO DISCUSS A RESPONSE TO A REQUEST FOR ADDITIONAL INFORMATION RELATED TO THE LICENSE AMENDMENT REQUEST TO ADOPT 10 CFR 50.69 (EPID L-2018-LRM-0076)

On May 8, 2018, a Category 1 public teleconference was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Northern States Power Company, a Minnesota Corporation, doing business as Xcel Energy (Xcel Energy, the licensee). The purpose of the meeting was to discuss the licensee response to an NRC staff request for additional information (RAI) provide by letter dated March 13, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19072A298). The RAI was related to the license amendment request to adopt the provisions in Title 10 of the Code of Federal Regulations (10 CFR) 50.69. The NRC staff discussed the licensee's response to NRC RAI 02. Specifically, the response could be interpreted to suggest that the guidance in Nuclear Energy Institute (NEI) 00-04 "10 CFR 50.69 SSC [structure, system, and component] Categorization Guideline," could be applied inconsistent with NRC staff endorsement in Regulatory Guide (RG) 1.201, "Guidelines for Categorizing Structures, Systems, and Components in Nuclear Power Plants According to their Safety Significance." The problematic information in question consists of four paragraphs that starts on page 12 of 31 of the RAI responses with, "As stated in Stage F, Section 8.1, of NUREG-1855, Revision 1, an appropriate method for ... " and ends in the second to last paragraph on page 13 of 31 with, " ... would have a significant impact on the risk ranking results."

The licensee acknowledged that the information provided could be interpreted as the NRC staff discussed. Xcel Energy stated that they would supplement the RAI response to remove the information and believed they could provide that supplement by the end of the following week of May 17, 2019.

Subsequent to the public teleconference, the NRC staff discussed the response to RAI 07, "Proposed License Condition" with members of the Xcel Energy's staff on Friday May 10, 2019.

The proposed license condition would require submittal of a license amendment pursuant to 10 CFR 50.90 for changes to the probabilistic risk assessment approved in the subject amendment. The NRC staff stated during the call that the licensee should consider using the term categorization approaches in lieu of the proposed categorization processes to more clearly describe when an amendment would be necessary. The licensee indicated that it would

consider the NRC staff's comments and may include a revision to the license condition in the planned submittal.
