I am sorry for the delay in writing to yo4, but I have just returned.

from the hospital.

I On February 16 I wrote to Mr. C .s. Thompson, J'r., Deputy District Engineers, LTC Corps of Engineers, Det~oit office, for clarification of specific items in which we as a coIJUTlittee of property owners are interested. The impending approval of a permit to erect a temporary barge slip or sink steel piling to prepare a pathway for the arrival of a generator via barge on the lake to Consumers Power plant at Palisades Park, Michigan is the cause of our concern.

We are very concerned if anyone is permitted to erect any type of barrier in the lake North of our Park. One needs only to know the history of the erection of the pier at Michigan City, Inl.iana by the Army Corps of Engineers and the devastation that resulted from it to the entire Heverly Shores area to the South of the pier to realize what can happen. Of course the Michigan City residents *were delighted by their new found land which they have used as a recreation area. B,ut the utter destruction of the entire Heverly Shores area is a .mute warning to anyone who understands the currents in the lake and what happens to the shoreline when the littoral drift is prevented from nourishing the beaches.

According to Mr. Thompson my questions should be directed to you. I am enclosing a copy of my February 16 letter to alert .you to our items of concern. The 167 property owners of our park would like the answers to our questions. J.i'or example: we are not su~e what is meant by "moni taring".

Does it include photographing regularly any changes in _saifdh§"r~5":l)~i31 across the extent of Palisades Park property? Please see paragraph-four of my letter of February 16,. 1981 *..

In order to protect the pro*perty owners of Palisades Park, we would like to request that you insist tha.t Consumers Power Company post a $10,000,000 bond to guarantee the protection they are claiming.

Dear Ms. Molyneaux:

Reference your letter of 16 February 1981 concerning a Department of Anny permit issued to Consumers Power Company (CPC) to construct temporary

  • off-loading facilities at the Palisades Nuclear Power Generating Station in Lake Michigan near South Haven, Michigan.

Prior to issuance of the Department of Army permit, my staff analysed the potential effects the proposed activities could have on adjacent shoreline properties. The analysis indicated that adjacent properties would not be damaged since CPC owns 2400 feet of shoreline property to the north and 2900 feet of shoreline property to the south of the generating facility. The CPC will be required to submit a shoreline monitoring program that must be approved by the District Engineer before construction can begin. The CPC will provide mitigation if necessary as directed by th.eJ.District Engineer.

CPC is also required to coordinate the entire project with the Nuclear Regulatory Commission (NRC). By Council on Environmental Quality (CEQ) definition in CEQ regulations, the NRC is considered to be the lead Federal agency. Therefore, the Corps' evaluation of the proposal concerned only the activities covered by Section 10 of the 1899 River and Harbor Act and Section 404 of the 1977 Clean Water Act. Duplication of review at both agency levels is an added burden and expense. I suggest that you contact NRC on any other matters pertaining to the overall project.
