By letter dated December 23, 2017 (Agencywide Documents Access and Management Accession No. ML14002A086), as supplemented by letters dated February 14, 2014; April 27, May 27, June 26, November 6, and December 21; February 24 and May 12, 2016; January 30, April 21, June 23, August 22, and October 25, 2017 (ADAMS Accession Nos. ML14051A499, ML15118A484, ML15147A372, ML15177A110, ML15313A306, ML15356A136, ML16055A160, ML16133A340, ML17030A312, ML17111A882, ML17177A097, ML17235A512, and ML17298B171, respectively), FirstEnergy Nuclear Operating Company (FENOC or the licensee) requested review and approval to transition the fire protection licensing basis at Beaver Valley Power Station (Beaver Valley), Unit Nos. 1 and 2, from Title 1 O of the Code of Federal Regulations (10 CFR) Section 50.48(b) to 10 CFR 50.48(c), NFPA 805, "Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants," 2001 Edition.
The licensee requested the amendments in order to establish and maintain a risk-informed, performance-based fire protection program in accordance with the requirements in 10 CFR 50.48(c).
Enclosed is the draft Safety Evaluation (SE) the U.S. Nuclear Regulatory Commission (NRC) staff has prepared to support the amendment request. Pursuant to 10 CFR 2.390, the NRC staff has made a preliminary determination that the enclosed draft SE does not contain sensitive unclassified non-safeguards information (SUNSI). The NRC staff requests that the licensee confirm that the draft does not contain any SUNSI. The draft SE is also being sent to the licensee for review for factual accuracy and completeness, with the Office of Nuclear Reactor Regulation (NRR) Director-level approval.

The NRC staff requests that FENOC provide comments regarding the factual accuracy, completeness, and SUNSI in the draft SE by November 30, 2017.
Since the NRC staff review is not yet complete, this letter and the enclosure do not convey or represent an NRC staff position regarding the license amendment request. Should the license amendments be approved, the NRC staff will issue a publicly available, non-SUNSI version of the amendment package.
