En losed you will ind two sets of a completed application form fo- renewal of the NPD""S permit for FPL's St. Lucie Plant. FPL Check '.;o. 413066 for ~j.'00.00 is also enclosed to cover eight sur ace water discharge serials.

Pertinent factors or circumstances, which are of particular impo" ance rerarding the attached application, are discussed in detail on an item-by-item> basis and attached as Appendix A.

Of particular import nce is FPL's objective to incorporate into the NPDES permit all nonradiolocrical limitations and monitoring requirements includ'g those pertaining to the biological monitor-ing program, currentl'y misplaced under NRC jurisdiction in the PSL Appendix 8 Er.vironmental Techn'cal Specifications (ETS). Please refe- to items 1 and 4 of Appen" x A of this application. FPL believes that it 's appropriate '.or NRC to delete logical Append'x B ETS requirem= .ts, including those pertaining all nonradio-to b'>ota, concurrently w'th the reissuance of the NPDES permitFPL, for St. Lucie Plant. Therefore, proper coord'nation between EPA and NRC is essential. A request for deletion of such St. Lucie Uni No. 1 ETS requ'rements nas been submitted in part to the NRC previously. An additional request will be submitted to the NRC in the r.ear future. FPL seeks any assistance you can render in th's matter.

Appendix B of this applicatior. contains FPL's proposed PSL Unit No. 2 preoperational and PSL Unit No. 1 operational biological monitoring program.

APPENDIX A DISCUSSXON OF SPECIFIC ITEMS RELATXNG TO ST. LUCXE PLANT (PSL) RENEWAL APPLICATION Item 1 EPA JURISDXCATION: NON-RADXOLOGICAL DISCHARGES PROM PSL FPL respectfully requests that EPA exercise its jurisdiction under the Clean Water Act of 1977 as amended to regulate'n its entirety discharges of non-radiological effluents to "Navigable Waters of the U-; S." It is FPL's belief that non-radiological chemical and thermal discharges from PSL as applied for should be solely regulated under the NPDES permit system ~onl and should not be duplicated via the Appendix B Environmental Technical Specifications (ETS) of the NRC operating license for St. Lucie Unit No. 1. Although FPL does-."not dispute the fact that NRC has the right to review and comment on the conditions which EPA proposes for regulation of non-radiological discharges at PSL, it does believe that EPA has final authority, after an appropriate evaluation of the comments from NRC and other interested agencies, to determine NPDES permit limitations and monitoring programs. This opinion is supported by the Atomic Safety and Licensing Appeal Board decision commonly known as the "Yellow Creek Decision" (ALAB-515). On the basis of Yellow Creek, FPL has previously requested deletion of all non-radiological chemical and thermal limitations and.. monitoring requirements from the PSL Unit No. 1 ETS by its letters dated April 12, and September 10, 1979. Copies of this corres-pondence are attached to this transmittal for your information.

Upon receipt of NRC's approval of these requests, FPL's goals will have been realized in part. However, requirements for the monitoring of aquatic biota which could be impacted by PSL's discharges are also a part of the ETS. FPL believes that these requirements should also be determined by EPA and therefore FPL proposes their incorporation into the PSL NPDES permit. FPL-would propose that NRC delete these requirements from the PSL Unit No. 1 ETS upon their incorporation into the NPDES permit. Regulation of non-radiological effluents in their entirety by EPA would then be complete. Accordingly, FPL is sending a copy of this transmittal and its component parts to appropriate personnel at NRC.
