Catawba Units 1 and 2 Docket Numbers 50-413 and 50-414 Request to Use a Portion of a Later Edition of the ASME Boiler and Pressure Vessel Code, Section Xl, for Inservice Inspection Activities Pursuant to 10 CFR 50.55a(g)(4)(iv) and in accordance with the guidance provided in NRC Regulatory Issue Summary (RIS) 2004-12, dated July 28, 2004, Duke Energy hereby requests NRC approval to use the ASME Boiler and Pressure Vessel Code,Section XI, 2007 Edition with the 2008 Addenda in lieu of the 1998 Edition with the 2000 Addenda requirements for inservice inspection of Class 1 pressure retaining welds in valve bodies.

This request is being made for the third ten-year inservice inspection intervals for both Units 1 and 2. The applicable ASME Section XI Code of Record for these inspection intervals is the 1998 Edition with the 2000 Addenda.

" The Unit 1 third inservice inspection interval began on June 29, 2005 and is currently scheduled to end on June 29, 2016.

  • The Unit 2 third inservice inspection interval began on October 15, 2005 and is currently scheduled to end on February 19, 2017.

Per this letter, Duke Energy is requesting to use the ASME Boiler and Pressure Vessel Code,Section XI, 2007 Edition with the 2008 Addenda in lieu of the requirement to examine Class 1 pressure retaining welds in valve bodies in accordance with the ASME Code, Section Xl, 1998 Edition with the 2000 Addenda, Table IWB-2500-1, Examination .Category B-M-1. This request is being made because using the 2007 Edition with the 2008 Addenda of Section XI will eliminate the need to perform the Category B-M-1 examinations, thereby eliminating the radiological dose that would otherwise be incurred by performing these examinations.

As noted in RIS 2004-12, licensees seeking to use later editions and addenda of the ASME Code,Section XI, pursuant to 10 CFR 50.55a(f)(4)(iv) or 10 CFR 50.55a(g)(4)(iv), are not required to request an alternative pursuant to 10 CFR 50.55a(a)(3) (now 10 CFR 50.55a(z)), or to request relief pursuant to 10 CFR 50.55a(f)(5)(iv) or 10 CFR 50.55a(g)(5)(iv). RIS 2004-12 also notes that the regulations do not specify when a licensee must submit a letter requesting www.duke-energy.com

Therefore, Duke Energy plans to use the proposed later Code edition and addenda for the specific application noted upon submittal of this letter.

There are no related requirements associated with the proposed later Code edition and addenda for consideration associated with this request.
