LA CROSSE BOILING WATER REACTOR - ISSUANCE OF EXEMPTION FROM CERTAIN EMERGENCY PLANNING REQUIREMENTS (TAC NO. J00438)
Dear Mr. Berg:
By letter dated June 18, 2012, Dairyland Power Cooperative requested exemption from specific emergency planning requirements of section 50.47, Emergency Plans, of Title 10 of the Code of Federal Regulations (10 CFR) and 10 CFR Part 50, Appendix E, Emergency Planning and Preparedness for Production and Utilization Facilities, for the La Crosse Boiling Water Reactor Facility.
Pursuant to 10 CFR 50.12, the Commission may, upon application by any interested person or upon its own initiative, grant exemptions from the requirements of 10 CFR Part 50 when (1) the exemptions are authorized by law, will not present an undue risk to public health or safety, and are consistent with the common defense and security; and (2) when special circumstances are present.
The enclosed exemption Federal Register notice concludes that certain requested exemptions are authorized by law, will not endanger life or property or the common defense and security, are otherwise in the public interest, and that special circumstances are present based on the reduced radiological risk to the public from an ISFSI at a permanently shutdown, defueled reactor. Accordingly, pursuant to 10 CFR 50.12, as specified in the enclosed notice, certain exemption requests are granted and effective immediately. The exemption will be published in the Federal Register.
Other requirements from which you requested exemptions were determined to be not applicable to your facility or are being met by your current emergency plan. Therefore, an exemption was not necessary or was denied for those requirements. The enclosed U.S. Nuclear Regulatory Commission (NRC) staff Safety Evaluation Report articulates the basis for granting and denying your specific exemption requests or determining that the requests were not necessary.
W. Berg 2 Pursuant to 10 CFR 51.21, 51.32, and 51.35, an environmental assessment and finding of no significant impact related to this exemption was published in the Federal Register. Based upon the environmental assessment, the Commission has determined that issuance of this exemption will not have a significant effect on the quality of the human environment. The exemption will be published in the Federal Register.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs Agency-wide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). The Safety Evaluation Report contains Sensitive Unclassified Non-Safeguards Information (SUNSI) and is being withheld from public inspection in accordance with 10 CFR 2.390.
