SUMMARY

I. Executive Summary The post plume portion of the exercise in the 50-mile Ingestion Pathway Emergency Planning Zone (IPZ) around the FitzPatrick Nuclear Power Plant began on June 21, 2012 following the release termination. The exercise extended through June 22 and 23 and was evaluated by the Federal Emergency Management Agency (FEMA), Region II. The purpose of the exercise was to assess the level of State and local preparedness in responding to a radiological emergency.

This exercise was held in accordance with FEMA's policies and guidance concerning the exercise of State and local radiological emergency response plans (RERPs) and procedures.

The most recent full-scale, federally-evaluated exercise at this site was conducted on September 22, 2009. The qualifying emergency preparedness exercise was conducted on September 15, 1981.

FEMA wishes to acknowledge the efforts of the many individuals in New York State and the counties of: Oswego, Onondaga, Cayuga, Jefferson, Lewis, Madison, Oneida, Ontario, Seneca and Wayne who participated in this exercise.

Protecting the public health and safety is the full-time job of some of the exercise participants and an additional assigned responsibility for others. Still others have willingly sought this responsibility by volunteering to provide vital emergency services to their communities.

Cooperation and teamwork of all 9the participants were evident during this exercise.

The State and local organizations, except where noted in this report, demonstrated knowledge of their emergency response plans and procedures and adequately implemented them. There were no Deficiencies and One Area Requiring Corrective Action (ARCA) identified as a result of the ingestion pathway exercise. In addition, one Planning Issue was identified. Corrective actions were demonstrated for the one prior ARCA.

II. INTRODUCTION On December 7, 1979, the President directed FEMA to assume the lead responsibility for all 4

FEMA's activities are conducted pursuant to 44 Code of Federal Regulations (CFR) Parts 350, 351 and 352. These regulations are a key element in the Radiological Emergency Preparedness (REP) Program that was established following the Three Mile Island Nuclear Station accident in March 1979.

FEMA Rule 44 CFR 350 establishes the policies and procedures for FEMA's initial and continued approval of State and local governments' radiological emergency planning and preparedness for commercial nuclear power plants. This approval is contingent, in part, on State and local governments' participation in joint exercises with licensees.

FEMA's responsibilities in radiological emergency planning for fixed nuclear facilities include the following:

  • Taking the lead in offsite emergency planning and in the review and evaluation of RERPs and procedures developed by State and local governments;

- Determining whether such plans and procedures can be implemented on the basis of observation and evaluation of exercises of the plans and procedures conducted by State and local governments;

- Responding to requests by the U.S. Nuclear Regulatory Commission (NRC) pursuant to the Memorandum of Understanding between the NRC and FEMA dated June 17, 1993 (Federal Register, Vol. 58, No. 176, September 14, 1993); and

- Coordinating the activities of Federal agencies with responsibilities in the radiological emergency planning process:

- U.S. Environmental Protection Agency,

- U.S. Department of Energy,

- U.S. Department of Health and Human Services,

Representatives of these agencies serve on the FEMA Region II Regional Assistance Committee (RAC), which is chaired by FEMA.

Formal submission of the RERPs for the Nine Mile Point and James A. FitzPatrick Nuclear Power Plants (JAFNPP), which share the site and the Emergency Planning Zone to FEMA Region Ii by New York State occurred on July 15 1981. Formal approval of the RERPs was granted by FEMA on February 1, 1985, under 44 CFR 350.

A radiological emergency response exercise was held and evaluated on June 22, 2011 by FEMA Region Ii to assess the capabilities of State and local emergency preparedness organizations in implementing their RERPs and procedures to protect the public health and safety during a radiological emergency involving the FitzPatrick Nuclear Power Plant. The purpose of this exercise report is to present the exercise results and findings on the performance of the offsite response organizations (ORO) during a simulated radiological emergency.

The findings presented in this report are based on the evaluations of the Federal evaluator team, with final determinations made by the FEMA Region II RAC Chairperson, and approved by the Regional Administrator.

The criteria utilized in the FEMA evaluation process are contained in:

  • NUREG-0654/FEMA-REP-1, Rev. 1, "Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants," November 1980;
  • "Radiological Emergency Preparedness: Exercise Evaluation Methodology," published in the Federal Register on September 12, 2001, and revised April 25, 2002, and contained in the Interim REP Program Manual (August-15, 2003)

Section III of this report, "Exercise Overview," presents basic information and data relevant to the exercise. This section of the report contains a description of the Ingestion Pathway Zone IPZ, a listing of all participating jurisdictions and functional entities that were evaluated, and a tabular presentation of the time of actual occurrence of key exercise events and activities.

FitzPatrick Section IV of this report, "Exercise Evaluation and Results," presents detailed information on the demonstration of applicable exercise objectives at each jurisdiction or functional entity evaluated in a jurisdiction-based, issues-only format. This section also contains as applicable: (1) descriptions of all Deficiencies and ARCAs assessed during this exercise, and the recommended corrective actions, and (2) descriptions of unresolved ARCAs assessed during previous exercises and the status of the OROs' efforts to resolve them. The Improvement Plan for outstanding issues is contained in Appendix A.

III. EXERCISE OVERVIEW This section includes data and basic information relevant to the ingestion phase of the exercise extending from the release termination on June 21, 2011 through June 22 & 23. The purpose of exercise is to test the offsite emergency response capabilities in the area surrounding the James A.

FitzPatrick Nuclear Power Plant. This section of the exercise report includes a description of the ingestion exposure pathway EPZ, a listing of all participating jurisdictions and functional entities that were evaluated, and a tabular presentation of the time of actual occurrence of key exercise events and activities.

A. Ingestion Pathway Zone Description The ingestion pathway zone for the Nine Mile Point/James A. FitzPatrick site encompasses the counties of Cayuga, Jefferson, Lewis, Madison, Oneida, Onondaga, Ontario, Oswego, Seneca, and Yates, Counties. The area is predominantly rural in nature with most of its total land acres consisting of woodland, wetlands, and inactive agricultural land. Although active agriculture land only accounts for a small percentage of the local land acres, agriculture is the major land use in most of the counties. The major agriculture activity in the counties is dairy, accounting for a large percent of the value of all farm products produced in the area. The major harvested crops are hay, alfalfa, and corn. The major livestock animals are cattle and hogs. The total population of the 10 ingestion pathway counties is 1,228,442 (2011 Population Estimates). The counties of Seneca, Yates, Onondaga and Ontario constitute the popular New York State Finger Lakes Region. The area extends southward from a 75-mile-long (120-kilometer-long) line reaching roughly from Syracuse in the east to Rochester in the west. The region is well known for its wineries, stunning scenery and important historic sites.

There are also a number of special facilities located within the 50-mile IPZ. Continuing urban and industrial expansion of the area will increase both the population and the amount of land used for residential and commercial purposes.

It is anticipated that the population in the region will increase by about 30 percent in the next twenty years, with larger increases in the urban areas.

SUMMARY

2.1 Exercise Purpose and Design The DHS/FEMA Region II Office evaluated the ingestion pathway portion of the exercise which began on June 21, 2011 following the release termination. The exercise extended through June 22 - 23, 2011 to assess the capabilities of the local emergency preparedness organizations in implementing their Radiological Emergency Response Plans and Procedures to protect the public health and safety during a radiological emergency involving James A. FitzPatick Nuclear Power Plant. The purpose of this report is to represent the results of the findings on the performance of the offsite response organizations during a simulated radiological emergency.

2.2 Exercise Objectives, Capabilities and Activities The Offsite Exercise objectives and capabilities for the James A. FitzPatrick full participation plume and ingestion exercise are discussed in the Extent of Play Agreement, Rev. 8, June 2, 2011 in Appendix E of this report.

2.3 Scenario Summary SCOPE The scope of the 2011 James A. Fitzpatrick Nuclear Power Station (JAFNPS) Ingestion Pathway Federally Evaluated Exercise is focused on the activities of the State agencies responsible for determining and implementing post-radiological emergency measures during the post-plume phase of a simulated accident at the JAFNPS. The post-plume phase is the period beginning after releases of radioactive material have been brought under control and the period of deposition of radioactivity has ceased. This phase of a radiological emergency may take from weeks to many months to complete depending on the severity and extent of the release of radioactive material to the environment. Fully demonstrating this response is well beyond the scope of this exercise.

However, the State of New York will demonstrate key response actions and objectives based on the simulated deposition of radioactive material resulting from the off-site release and assumed scenario 30 - day time jump postulated throughout the exercise sequence of events.

The major exercise events to be demonstrated will include protective action decision making and implementation of actions resulting in protection of the public from direct long-term exposure to deposited radioactive material and ingestion of contaminated food and water. To allow the 13

FitzPatrick demonstration of these activities, simulated scenario times, information and data will be provided to exercise participants for the demonstration of the exercise objectives. The season assumed for the purposes of the exercise is Spring with the date being Wednesday, June 22, 2011. The specific schedule of events and timing of exercise events is provided in the table presented below and the detailed sequence of events.

Each jurisdiction and functional entity was evaluated on the basis of its demonstration of criteria contained in the September 12, 2001 Federal Register Notice (revised April 25, 2002) and in the Interim REP Program Manual (August 15, 2002).

ISSUE NO.: 24-11-5b l-A-03 CRITERION: OROs provide accurate emergency information and instructions to the public and news media in a timely manner.

CONDITION: Public Information was inconsistent on the second day of exercise play. The talking points for the Director of the Department of Health for the press conference that was to take place at 1400 stated that ERPA 3 remained evacuated, and also that those in ERPA 3 can return to their homes.

Also, Press Release #1 (1600) stated that the general agricultural embargo area had been reduced from the original 50-mile radius, and food in this reduced area should not be harvested or eaten. In a subsequent paragraph, it stated that food should not be consumed within a 50-mile radius of the affected area. Both statements refered to an attached map, which only displayed the reduced embargo area.

POSSIBLE CAUSE: Lack of a detailed review of the talking points and Press Release.

ISSUE NO.: 27-05-3eI-A-01 ISSUE: The Wayne County USDA representative sent a message [by e-mail at 1604, Day 2, to the State Agriculture and Marketing representative in the Emergency Coordination Center (ECC)], that the State Dairy Farm database was not up-to-date.

CORRECTIVE ACTION DEMONSTRATED: For the ARCA from 2005 concerning updates to the State Dairy Farm database, an interview was conducted with representatives from Department of Agriculture and Marketing (Ag & Markets),

USDA Farm Service Agency (FSA), Cornell Cooperative Extension (CCE),

Rochester Institute of Technology (RIT) Digital Imaging and Remote Sensing Lab, and NYSOEM.

Ag & Markets has just a central office, so the main source of information is through certified milk inspectors, employed by the cooperatives, who regularly inspect the milk at critical nodes before going to market. The inspectors report that information which is then entered into the State Dairy Farm database. Information regarding location goes to the NYSOEM GIS for enhanced mapping using high resolution photography and county parcel data.

Additionally, Ag & Markets coordinates with the CCE, which has a representative in almost every county in New York, to implement a program to connect the land-grant University's research to its community. The CCE does agriculture research and liaises between the farmers/producers in the county. Ag & Markets updated their procedures which now call for an annual check of the State Dairy Farm database with information from CCE and FSA. After database updates are made, Ag & Markets sends the information to every county office of emergency management.

The RIT Digital Imaging and Remote Sensing Lab is doing research on how it can rapidly identify and quantify agricultural impact of a radioactive plume from a nuclear power station through total acreage (by crop type) and identification of affected properties (via owner name/street address). They are working to develop a tool that can automatically and within hours, ingest satellite imagery, apply spectral processing, integrate available GIS data, compute acreage, highlight areas, identify affected land owners, and format map products for visualization. The RIT representative showed the maps they are capable of developing, and explained they will continue to work to improve the tool's capabilities.

All of the mentioned elements worked to assist Ag & Markets in assessing and disseminating information regarding crops and dairy embargoes throughout the exercise. The prior ARCA has been cleared.

The major exercise events demonstrated included protective action decision making and implementation of actions resulting in protection of the public from direct long term exposure to deposited radioactive material and ingestion of contaminated food and water. To allow the demonstration of these activities, simulated scenario times, information and data were provided to exercise participants. The New York State Office of Emergency Management conducted regularly scheduled conference calls with the ten ingestion pathway counties to coordinate these activities.

FIELD MONITORING TEAMS Extent-of-Play Agreement:

  • The County will dispatch two (2) radiological monitoring teams. Each team will be provided with a State Controller and FEMA evaluator.

Each team will take at least six (6) ambient radiation measurements and at least two (2) air samples. All teams must take the air samples as though they were in the presence of the plume (even teams that may not be impacted by the plume).

  • The use of silver zeolite cartridges will be simulated and charcoal cartridges will be used. However, the silver zeolite cartridges are available in the kit.
  • There will be no actual transport of samples to the laboratory. All arrangements up to transport will be demonstrated. EOC staff will be questioned only regarding means of transportation of air samples to a central point and the location of the laboratory. Field teams will demonstrate how to obtain air samples during the exercise and will be questioned only regarding the procedures for the pick-up point of air samples.
  • The RO2A and E140N do not have installed check sources. Button sources for the E140N are available for inspection.

Extent-of-Play Agreement:

  • The transportation and facility component of this medical drill will be demonstrated in accordance with the offsite extent-of-play agreement schedule.
  • The drill will involve the transport of a patient from the Nine Mile Point site to Oswego Hospital for treatment. This component was/will be evaluated on October 21, 2011.
  • The use of flashing lights and sirens for exercise play is not required.
