S. Nuclear Regulatory Commission (NRC) for the renewal of Facility Operating Licenses DPR-80 and DPR-82, for Diablo Canyon Power Plant (DCPP) Units 1 and 2, respectively.

The application included the license renewal application (LRA), and Applicant's Environmental Report -Operating License Renewal Stage.In response to NRC staff requests during its April 19, 2010 to April 27, 2010, environmental audit at DCPP, PG&E is providing its responses to NRC staff requests in Enclosure

Some dry waste is packaged on-site in boxes and shipped directly to low level radioactive waste (LLRW) disposal -currently Clive, Utah (200 to 300 ft 3/yr). Typically, one large container (200 ft 3) of Class A resin is packaged on-site every one to two years and shipped in a cask to a LLRW disposal site as noted above.Class B and C Diablo Canyon Power Plant (DCPP) currently stores Class B and Consite.DCPP has three 88 ft 3 containers of Class C cement encapsulated cartridge filters and two 98 ft 3 containers of polymer solidified Class B/C resin in the DCPP Radwaste Storage Building.

The building can hold 180 such containers.

DCPP's generation rate for Class B and C is projected to be two containers per year (one of filters and one of resin). Should the newly licensed site in Texas open to DCPP, shipments of Class B and C packages for disposal would resume. Shipments may be constrained by leased shipping cask availability (only six Type B casks for the entire USA) and budget.

Enclosure 1 PG&E Letter DCL-10-081 Sheet 5 of 23 Audit Request 5 Provide Fuels Management Plan.PG&E Response 5 The Diablo Canyon Power Plant Fuels Management Program periodically maps the vegetation fuel types and conducts annual monitoring to document change in fuel types as well as environmental conditions.

This information is used to determine annual vegetation management treatments.

Goat grazing is used as one of the vegetation secondary management treatments.

PG&E Response 8 PG&E currently has two license agreements for livestock grazing on Diablo Canyon Land with two ranchers, Mr. Blanchard and Mr. Mello.PG&E License Agreement, License Agreement for Grazing Purposes, Section 5, states: "Licensee shall conduct Licensee's livestock operation in accordance with good and prudent management, and Licensee will not permit the property to be overgrazed." The License Agreement requires the ranchers to follow the Residual Dry Matter Monitoring Program guidelines.

PG&E Response 9 The following tables show the herbicide usage in the immediate area of the Diablo Canyon Power Plant site. Typical products used and average rates of application are included in Table 1. Estimates of average annual herbicide use within the plant site area based on average rate of application' by product and the extent of area each product is applied to is shown in Table 2. An actual example of total herbicide usage for the year 2000 as reported to the county Agricultural Commissioner's office is shown in Table 3. P&E Response 10 The corporate policy on environmental issues is entitled "PG&E Corporation Environmental Policy Framework.", In 2008, PG&E revised the corporate Environmental Policy, which shortened the overall policy but required PG&E to develop an Environmental Management System (USP 17). USP 17 mandated an Environmental Training Program..

Assembly Bill 292 states "The maximum annual amount available for disbursement for local costs, subject to subdivisions (e) and (f), shall, for the fiscal year beginning July 1, 2009, be one million seven hundred thirty-two thousand dollars ($1,732,000) for the Diablo Canyon site and one million six hundred thousand dollars ($1,600,000) for the San Onofre site." This legislation also has a formula of California Price index or prevailing wage paid to the County as an escalator clause. They rotate participation in drills and exercises and are provided the funding in the year that they participate.

Enclosure 1 PG&E Letter DCL-10-081 Sheet 16 of 23 In addition to funding from Diablo Canyon Power Plant to the nonprofit community to perform contractual work to enhance the effectiveness of the emergency plan, PG&E makes philanthropic donations to key nonprofits to further support emergency preparedness and life saving programs that would be called upon for any major disaster.

Specifically, in San Luis Obispo County PG&E has focused on two initiatives that are also supported by the County Office of Emergency services.

They are the 211 program, now hosted by the United Way, and Voluntary Organizations Active in Disaster (VOAD); a county wide collaboration amongst the nonprofit community, hosted by the American Red Cross.Each program is designed to complement emergency services provided by public agency emergency responders.

In short, their mission should direct community members to important services that are needed during emergencies but are not appropriate uses of the 911 system. Additionally, both the VOAD and 211 missions raise emergency preparedness awareness through the collective memberships of the nonprofit community, touching thousands of county residents.

OP=3871 &lDCapitulo=4ig5ok s568 Enclosure 1 PG&E Letter DCL-10-081 Sheet 17 of 23 Audit Request 13 Provide information about any changes in assessed property value or any other recent or anticipated payment adjustments that could result in notable increases or decreases in tax or other payments.PG&E Response 13 Property taxes will increase as capital investment in Diablo Canyon Power Plant (DCPP) continues and will decrease with depreciation and reduce capital investment.

PG&E provides the following sample 20-year window to demonstrate the incremental impact that continued investment in DCPP would have on property taxes, assuming the DCPP operating licenses berenewed and PG&E decides to operate the plant during the renewed period. PG&E estimates the capital spending at DCPP at approximately

$3.2 billion from 2010 to 2029 inclusive, should the operating license be renewed (See table provided below). PG&E forecasts the net impact of DCPP capital additions on tax payments to be approximately

$282.3 million over this same 20-year period (See table on Sheet 18). This is in addition to the normal property taxes that PG&E pays. Enclosure 1 PG&E Letter DCL-10-081 Sheet 19 of 23 Audit Request 14 How many van pools are used for commuting purposes?PG&E Response 14 Diablo Canyon Power Plant (DCPP) currently has eight (12 passenger) van pools that are used for commuting purposes.

The vans normally operate four days per week to match DCPP workers four days per week -ten hours per day work schedule.

The vanpooling is available to PG&E, long term contractor, and refueling outage temporary personnel.

During refueling outages the vans may operate five or six days per week to accommodate additional worker transportation needs and help to mitigate parking shortages at DCPP. The following table provides information on departure locations, stops, and times.Departure Location & Time Stop Location(s)

Enclosure 1 PG&E Letter DCL-10-081 Sheet 22 of 23 Audit Question 17 Provide a copy of 97-03-DWQ National Pollutant Discharge Elimination System General Permit.PG&E Response 17 Water Quality Order No. 97-03-DWQ National Pollutant Discharge Elimination System (NPDES) General Permit No. CAS000001 (General Permit) "Waste Discharge Requirement (WDRS) for Discharges of Storm Water Associated with Industrial Activities Excluding Construction Activities" is not a permit specific to the Diablo Canyon Power Plant (DCPP) facility.

The General Permit is implemented statewide by the California State Water Resources Control Board (SWRCB), and is intended to apply to those industrial facilities that do not have site specific permits, which incorporate or address storm water discharges.

Order No. 97-03-DWQ was/is not issued directly to industrial facilities, and therefore DCPP does not maintain a formal site specific copy. The General Permit may periodically be modified, updated, or replaced in entirety by the State. The most current version of the General Permit is maintained by, and available directly from, the SWRCB.Industrial facilities complete and file a Notice of Intent (NOI) to enroll in the General Storm Water Permit Program. Once an NOI is filed, a facility is registered in the program and provided a site specific Identification Number (ID), required to pay an annual program fee, and expected to implement the current provisions of the General Permit including completion and submittal of an annual report.The current DCPP NPDES Industrial.

Waste Water Discharge Permit No. CA0003751, Order 90-09 incorporates site storm water discharges.

PG&E submitted an NOI to enter the State Industrial Storm Water General Permit Program in July 2, 2003, in anticipation of renewal of the NPDES Industrial Waste Water Discharge Permit. The renewed permit would not have incorporated stormwater discharges, and therefore, participation in the Storm Water General Permit Program would have subsequently been appropriate.

However, the NPDES Industrial Waste Water Discharge Permit was not renewed in July of 2003. The California Regional Water Quality Control Board Central Coast Region (CRWQCB) then issued a letter indicating that DCPP's storm water would continue to be covered under the existing Order 90-09 until a revised NPDES permit was adopted.Due to ongoing delay of renewal of the NPDES Industrial Waste Water Discharge Permit, PG&E voluntarily agreed to conditionally implement provisions of the State Industrial Storm Water General Permit Program in November of 2006.
