THREE MILE ISLAND NUCLEAR STATION, UNIT 1 - ACCEPTANCE OF REQUESTED LICENSING ACTION RE: LICENSE AMENDMENT REQUEST TO ADOPT TSTF-490-A, REVISION 0, DELETION OF E BAR DEFINITION AND REVISION TO REACTOR COOLANT SYSTEM SPECIFIC ACTIVITY TECHNICAL SPECIFICATION (TAC NO. ME0100)

Dear Mr. Pardee:

By letter dated November 6, 2008, (Agencywide Documents Access and Management System (ADAMS) Accession Number ML083120122), AmerGen Energy Company, LLC (AmerGen) submitted a license amendment request for Three Mile Island Nuclear Station, Unit 1 (TMI-1).

The proposed amendment would replace the current TMI-1 technical specification (TS) limit on Reactor Coolant System (RCS) gross specific activity with a new limit on RCS noble gas specific activity. The noble gas specific activity limit would be based on a new dose equivalent Xe-133 definition that would replace the current E Bar average disintegration energy definition. In addition, the current dose equivalent 1-131 definition would be revised to allow the use of additional sources of thyroid dose conversion factors. By letter dated December 11, 2008, (ADAMS Accession Number ML083470249), the license amendment request was supplemented by AmerGen in response to a request for clarification from the U.S. Nuclear Regulatory Commission (NRC) staff (ADAMS Accession Number ML083390304). The purpose of this letter is to provide the results of the NRC staffs acceptance review of this amendment request.

The NRC staff has reviewed your application, including the supplement dated December 11, 2008, and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Based on the anticipated review requirements, the staff plans to process this amendment without using the Consolidated Line Item Improvement Process. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
