Dear Tim Devik,

Thank you for submitting information concerning the above referenced project. The Pennsylvania State Historic Preservation Office (PA SHPO) reviews projects in accordance with state and federal laws. Section 106 of the National Historic Preservation Act of 1966, and the implementing regulations (36 CFR Part 800) of the Advisory Council on Historic Preservation, is the primary federal legislation. The Environmental Rights amendment, Article 1, Section 27 of the Pennsylvania Constitution and the Pennsylvania History Code, 37 Pa. Cons. Stat. Section 500 et seq. (1988) is the primary state legislation. These laws include consideration of the project's potential effects on both historic and archaeological resources.

Archaeological Resources More Information Requested - Environmental Review - More Info - Archaeological - Known Site

The following archaeological resources are located within or immediately adjacent to the Area of Potential Effects (APE), from north to south:

36DA0050: This site is located immediately north of the APE. Portions of this archaeological site are very likely intact but are entirely outside the APE.

36DA0097: This site is mapped at the northern edge of the APE, both within and outside of the APE. Intact portions of the site may be present outside the APE, adjacent to 36DA0050; however, it is our opinion that any portion of this site within the APE is now destroyed.

36DA0096: This site is mapped in the northeastern portion of the APE. It is our opinion that this site was destroyed by construction of TMI Unit 1 and TMI Unit 2.

36DA0098: This site is mapped at the southern end of the APE. Intact portions of this site may be present within the APE.

36DA0051: This site is also mapped at the southern end of the APE, southeast of 36DA0098.

Intact portions of this site may be present within the APE. A portion of this site has been previously evaluated; however, the site likely extends outside of the area previously surveyed.

Archaeological sites 36DA0098 and 36DA0051 are both located in a portion of the APE that may contain intact soils. These resources have not yet been evaluated for their eligibility for listing in the NRHP. Based on the currently defined APE for this project it is our opinion that a Phase IA geomorphological investigation should be conducted to determine if intact soils area present within ER Project #2021PR03278.012 Page 2 of 2

the APE, specifically in the portion of the APE generally south of TMI Unit 2. These geomorphology results would be used to determine areas that should not be used for borrowing activities and/or areas where Phase IB archaeological investigations should be conducted.

Alternatively, if this southern portion of the APE was decreased in size or specified as an area where no ground disturbance will occur, it would be our opinion that this geomorphology investigation would not be necessary. In such a case, we would continue to recommend consultation with our office regarding any proposed ground disturbance for borrowing activities outside the currently defined APE, as would be outlined in a Programmatic Agreement.
