FITNESS FOR DUTY PROGRAM PERFORMANCE DATA REPORT Situation Descriptions, Management Actions, and NRC Reportable Events January 01 - June 30, 2008 A. Situation Descriptions

1. One (1) Employee was confirmed positive for Cocaine as a result of a Random drug and alcohol test.
2. One (1) Contractor provided a sample that was below the acceptable temperature range as a result of a Pre-Access drug and alcohol test. Individual then refused to provide another test (For-Cause) under direct observation. Both (2) tests were considered refusals per the MRO.

Pre-Access urine sample was sent to HHS Certified Lab for testing.

3. One (1) Contractor provided a sample that was below the acceptable temperature range as a result of a Random drug and alcohol test. An immediate For-Cause test was done under direct observation. Both (2) tests were sent to the HHS Certified Lab for testing. Random was considered refusal per the MRO. For-Cause was confirmed positive for THC.
4. One (1), Contractor was confirmed positive for Cocaine as a result of a Follow-Up drug and alcohol test.
5. One (1), Contractor was confirmed positive for Cocaine as a result of a Random drug and alcohol test.
6. Three (3), Contractors were confirmed positive for Cocaine as a result of Pre-Access drug and alcohol testing.
7. Four (4), Contractors were confirmed positive for THC as a result of Pre-Access drug and alcohol testing.

B. Management Actions (in Response to Situation Descriptions)

The following actions were taken by management as a result of the above situation descriptions:

1. Unescorted Access was immediately terminated for one (1) employee for a minimum of one year. (1 above)
2. Unescorted Access was permanently denied as result of refusal to test for two (2) contractors. (2-3 above)
3. Unescorted Access was immediately terminated for two (2) contractors for a minimum of one year. (4-5 above)
4. Unescorted Access was immediately denied for seven (7) contractors for a minimum of one (1) year. (6-7 above)
5. Substance Abuse Referrals:

All individuals were encouraged to obtain a substance abuse evaluation to determine proper treatment and rehabilitation.

6. Review of safety-related work was performed where applicable. No remedial actions were required.

C. NRC Reportable Events (Per 10 CFR Part 26.73)

There were no reportable events during this performance data period .
