In Reference 1 the Nuclear Regulatory Commission (NRC) Staff requested information concerning the behavior of the Boraflex neutron absorber in the McGuire spent fuel storage pools in the presence of mixed oxide (MOX) fuel assemblies. In Reference 2 Duke Energy (Duke) informed the NRC of its decision to focus the MOX fuel lead assembly program solely on Catawba Nuclear Station. This decision removes McGuire from consideration for irradiation of MOX fuel lead assemblies. The questions in Reference 1 are no longer relevant to Duke's license amendment request to use MOX fuel lead assemblies because Catawba does not use Boraflex neutron absorbers in its spent fuel pools; therefore, Duke will provide no additional information on this topic.
