Florida Power and Light Company (FPL) submitted an application for license amendments to apply a Boraflex Remedy to the Spent Fuel Pools (SFP) for Turkey Point Units 3 and 4. This application was approved as License Amendment Nos. 234 and 229, respectively, in Reference

1. After approval, FPL informed the NRC of the inability to implement Unit 3 Amendment No.

234 by the specified implementation date (Reference 2). In Reference 3, FPL informed the NRC of the actions that it would take to address the status of the Boraflex neutron absorber in the Unit 3 SFP until License Amendment No. 234 could be implemented. Among the actions, FPL committed to submit to the NRC a License Amendment Request (LAR) updating the Unit 3 SFP licensing basis by February 28, 2010. This FPL commitment was satisfied by the submission of Reference 4.

The purpose of the Reference 4 LAR was to provide an interim licensing basis for the Unit 3 SFP continuing to credit Boraflex as a neutron absorber until such time as Unit 3 License Amendment No. 234 is implemented. At the time of FPL's commitment and LAR submission FPL had no aCoG an FPL Group company k-C ".

Florida Power and Light Company L-2010-128 License Amendment Request No. 204 Withdrawal Page 2 of 2 confidence that the Metamic inserts needed to implement License Amendment No. 234 could be fabricated according to specification on a reliable production schedule. Subsequently, MetamicTM insert fabrication difficulties have been overcome and the Unit 3 SFP has been configured in accordance with Unit 3 License Amendment No. 234. The implementation of License Amendment No. 234 means Boraflex is not credited as a neutron absorber in the Unit 3 SFP. Accordingly, FPL hereby requests withdrawal of License Amendment Request No. 204 (Reference 4) from NRC review.
