NRC INSPECTION REPORT 50-445/97-12;50-446/97-12 AND NOTICE OF VIOLATION

Dear Mr. Terry:

Thank you for your letters at July 10 and 11,1997, in response to our letter and the attached Notice of Violation dated June 11,1997. We have reviewed your replies for Violation A, and examples 1,2 and 5 of Violation B, and find them responsive to the concerns raised in our Notice of Violation. With respect to examples 3 and 4 of Violation B, and Violation D, we need more information to enable us to determine if adequate corrective actions were taken. The details of the information required for these examples are discussed below, in addition, as described below, we are also responding to your concern regarding a backfit discussed in your response to Violation C.

In your response to Violation A, we noted that your letter identified ambiguities in the reporting requirements. To address these ambiguities identified by you and other licensees, the NRC has formed a task force to clarify the event reporting requirements for 10 CFR 50.72 and 50.73. The task force will review NUREG-1022, Revision 1 (Second Draft), to determine what changes are necessary prior to finalizing the document.

Your response to Examples 3 and 4 of Violation B did not supply sufficient information to allow us to determine if your corrective actions were adequate to preclude recurrence.

For example, the response to Example 3 did not provide details regarding actions taken to fully assess the generic implications of the incorrect installation of the finger plates in the 500 diaphragm valves. With regard to Example 4, we considered your corrective actions stated in LER 96-02, addressing the metal fragment problem in the main feedwater

isolation valve solenoid, to be adequate. However, your response did not provide details regard:ng the reasons that corrective actions were not developed for previous slow

stroking occurrences and the actions you plan on taking to prevent a recurrence of this corrective action problem. Therefore, we request that you provide additional information q

detailing your corrective actions for Examples 3 and 4 of Violation B. Please provide this additional information within 30 days of the date of this letter.

. procedures would be revised. We request that you provide a completion date for these procedural revisions. Please provide this additional information within 30 days of the date of this letter.

We noted that your reply to Violation C concluded that this Violation represented a backfit issue, in accordance with our backfit process, your position is being forwarded to the Office of Nuclear Reactor Regulation for a review and analysis. We will reclassify Violation C, item 50-445:446/9712-05, as an unresolved item pending resolution of the Office of Nuclear Reactor Regulation review and analysis.
