NRC OFFICE OF INVESTIGATIONS REPORT 2-2010-023, AND SHEARON HARRIS NUCLEAR PLANT INSPECTION REPORT 05000400/2010405
Dear Mr. Burton:
This refers to the investigation completed on August 12, 2010, regarding security activities at your Shearon Harris Nuclear Power Plant, Unit 1. The purpose of the investigation was to review the facts and circumstances associated with a security related issue. The results of the investigation were discussed on September 21, 2010, with Mr. B. Bernard and other members of your staff.
Based on the results of this investigation, no findings were identified. However, two licensee-identified violations which were determined to be of very low safety significance are listed in this report. The NRC is treating these violations as non-cited violations (NCVs) consistent with Section 2.3.2 of the NRC Enforcement Policy because of the very low safety significance of the violations and because they were entered into your corrective actions program. If you contest these non-cited violations, you should provide a response within 30 days of the date of this inspection report with the basis of your denial, to the Nuclear Regulatory Commission, Regional Administrator, Region II; the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC Resident Inspector at the Shearon Harris Nuclear Station.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/readingrm/adams.html (the Public Electronic Reading Room). However, because of the security-related information contained in the enclosure, and in accordance with 10 CFR 2.390, a copy of the enclosures to this letter will not be available for public inspection.
